    Outsourcing is not a good business at all. If you work for a big american consulting company it is good. My company is a big company in India, but still people in my work location think we people are contractors (cheap sweepers) and we are great workers then those people. It is all due to green card I have to stay with this company. Stop outsourcing and IT consulting companies. They never understand that computer is a scrable game.

    Even if I back date my marriage (as advised) , How can I get my future wife to USA?. I cannot get her on depend status as my H1-B (I believe) got canceled on approval of GC.

    Issues I see,

    1. The back date of marriage must match to my stay at India.

    2. I did not visit India in the last one year.

    3. I applied my I-485 in the August 2008 time. So (I must mention my marriage and dependents in the application). Which I did not . So this does not work.

    See the troubles I have now.

    P.S: I did not want to cheat USA Immigration Dept. Not a good practice


    Let me know if there are any guanine ways.

    Don't even think about that, unless you want to go to jail. They can easily find out if you were staying in US while your marriage tookplace in India.

    The memo lists two preconditions for eligibility to change jobs- I485 is pending
    UN adjudicated for 180 days or more and the new job is in the similar occupational classification as the job for which the certification was initially made in section 106(c).
    In the present case, my client has had an H-1B transfer filed for him, and is utilizing
    AC21 provisions for a new job with the same title and duties as the former. Please find attached a letter from the current employer regarding the job title, duties and salary. I therefore respectfully request that your office should adjudicate my client�s I-485 accordingly under AC21 provisions. Should you have any further questions, please do not hesitate to contact me.

    I have attached the following requisite documentation including:

    I don't know if he is gonna mess it up if I file on my own. But Senthil has valid point that he should support if there is an RFE.

    Its a very good point... might as well take the hit now BUT make sure you give him the finger and a few words when you throw your resignation letter on his face after getting your ead or if you want to wait till you get your gc!

    Sucker will rot in hell for sure!

    EB3-I is a lost hope, i dont think there will be any movement for next 2-3 years. Year 2001, 2002 and 2003 had 185K H1Bs and even if we assume 100K being used by India and all of them applied for GC -(half of them in EB3 to be optimistic). The number would be 50K/year just primary applicants. So, to advance from 2002 with 50K applicants would take---you can guess. There are only ~4000 visas/year for EB3 India.

    Yeah I can understand... Well certain things defy logic.... Hope is all life is about :)
    I am not trying to sound preachy.... com'on man we do go to casinos even knowing that the probability of winning is acute...

    Employer letter is not required if you are attaching photocopies of two current pay stubs.

    You would need employee letter as well. The employee letter will state that the position is still open and they are willing the pay the amount that was initially agreed to while filing for labor.....so pay stub is not enough.....

    My received date is July 3rd for 485, I140 approved July 18, notice date June 26, 07. for AC21, Is my safe date Dec 30th or Dec 31st. Should I be working on the 31st December for current(485) employer or I am safe today?

    I know many people working here in my city who are from TCS. TCS blatantly breaks rules and sends these people on L1 visas while paying them an Indian salary and a minimal per diem for their time in the U.S. They don't even get enough for renting a car and I see many of these poor guys walking from their apartment blocks to the office. It's good exercise (for one's physical health) but the intent of the company is exploitation and nothing else :mad:

    In addition, I notice that many of these recruits are here not for long term jobs but for gaining enough knowledge so that those jobs can be outsourced back to the home country. That has started to make many of my American colleagues really mad. But it's the fault of the company, not these poor guys who don't have seem to have a clue what a bad deal it is until they arrive here.

    Sad to say, Wipro, Infosys and the rest in their flock are no better.


    Yup, TCS, Infosys, Cognizant, Patni etc are all offenders. Its sad to see L1s getting such a paltry salary.

    For H1 there are rules that are laid out for minimum wages but not for L1 (I think). Even then these Indian companies pay the least they have to to H1 visa holders.

    It is EB3row who deserve a good grudge with EB2India/China, regarding spill-over changes.

    IV is not a help group. If some one want to join a help group then go join a "Depressed people Organization". This is a make happen group, where we all fight for what is right. But unfortunately, we are just as strong as number of people actively supporting.

    He did everything right and followed the process but now for a VERY stupid reason, he has to wait for 6+ years now. So, the simple question I ask now is what justice it is by having such a complicated Green Card process full of so much uncertainity and unfairness.

    Thus, this guy of course should do all what you stated but must do much more, which is stand up for himself.




    How can you be so mean specially at a time when he is under tremendous pressure. IV should try to comfort him and suggest him some alternatives. Contact your attorney ASAP and ask him to try to have a good write up and send the application again, who knows USCIS might accept your application (worst case ur app will come back again), but make it fast dont delay anymore.

    I think, it is a combination of three things.
    1. Laziness
    2. No Accountability
    2. Bad intentions ...as you mentioned

    In my job, I am a software trainer. I teach hundreds of people. I will be accountable (and asked questions) if I delay my work even by one day. There are tight deadlines for everything. (Yes, 5 minute job of renewing EAD will not be 90 days ...it will be 5 minutes only) Even if one customer just soft complains about anything, I will be held accountable and my job will be in jeopardy. There is no such thing in USCIS.

    BTW: I hate when they say 90 days and then exclude the RFE time and the mail accepting time.(They count from the date of receipt and not the date of receiving the mail). On the top of it, the receipt date can be any time they want and not the date of receiving the date. It can become 120 days and when they say "days", it is like one of those commercials which says, " for only 1$ a day ...." instead of saying $365 which they charge for the whole year . subscription.

    Same way instead of saying 3 to 5 months , they say 90 days (so that it does not seem long). they should say , "EAD RENEWAL ONLY TAKES 129600 MINUTES". ..and then in the small print, light gray color at a hidden spot in the bottom, in tons of lines of text, say, "does not include RFE, holidays, Mail transit time, and time before we accept it"

    Can anybody please send me the address of USCIS director ? I want to write a letter to him with a copy to his boss too. Anybody can help me know who his boss is and his address too ?

    You will be barking up the wrong tree or up the same tree a lot of us have already barked up to, by writing to rthe Director of USCIS and his boss.
    Alejandro Mayorkas is the Director od USCIS and I believe his boss would be none other than Ms. Janet Napolitano..

    Poke around IV, there has to contact information for both of these individuals.
    Laziness and Un-accountability are hallmarks of any government organization in any country, so we can discount that. I strongly incline in the direction of "Bad Intentions".

    Afterall these are all clerk level employees who have, what amounts to the future of thousands of people, in their hands. Whenever USICS efficiency/operating procedures are discussed here, I am reminded of what a clerk in my engineering school in India once told me. Mind you, this was NOT a government office where dealinggs of millions of rupees are made. This was a SCHOOL.
    Following is the brief dialoge between the clerk and I:
    Clerk: "Bhai, clerk se hamesha dar ke rehna."

    Me" "Kyon?"

    Clerk:" KUTTA mein ek (one) "K" ( the hindi letter Ka), hota hai aur clerk mei 2, is liya dhyan rakha"

    That dude was so correct.
