more...This is Country Music — BradI talked to a staff member at senator Barbara's office, and the staff member said, Faxes and emails are responded and replied by staff reps. Only written (typed) letters go to Senator's attention. She also advised me that if this is something you need the senators attention on, do not send fax or email, send a letter with postage paid.
I explained to her the visa -flip flop, and she said most likely the senator will read and send an inquiry, The senator is very good at responding to letters from constituents.
That is exactly why we need to send them letters, please look at the format and add some personal details, gives it a little personal touch.
I agree. My experience thus far: I emailed 200 reporters and received no response. I am going to try the letters idea, because I too think what Amitjoey says is right-- letters make an impact.
Write a letter, run a grammar/spell check, then print, SIGN, and send it to senators who support us. I wrote the following. But please personalize, because that would send the message that this is an issue of importance to you-- the writer.

I have been living in ___, USA for the last ___ months/ years. By profession, I am a ____, and I work for ___, a company based in ___.
I am writing to bring to your attention the unprecedented decision made by US Department of State (DOS) on July 2, 2007 with its interim �visa bulletin�. With this bulletin, DOS determined that all the immigrant visa numbers allocated for the current financial year had been expended, and thus there would be no further authorizations of new Green Cards this year. In response, USCIS announced that it would return all Adjustment of Status applications it received, beginning July 2, 2007. Please note that the USCIS had already RECEIVED applications on the morning of July 2, 2007, even before DOS published this interim visa bulletin.
In my opinion it is an unfortunate decision in that it virtually renders null and void, thousands of properly filed Employment Based Green Card- Adjustment of Status applications.
An important thing to note here, is that in the Visa Bulletin published by DOS only 18 days ago (June 13, 2007) all Employment Based categories had been made �current� since almost 60000 immigrant visa numbers had been unused till that time.
This begs the question: how did USCIS manage to approve about 60000 green cards in less than 3 weeks, when it took the previous 8 months to approve the same number of green cards?
The Visa Bulletin published by DOS in June 2007, had brought good news to thousands of high-skilled temporary workers (doctors, engineers, IT professionals) in the USA, because the floodgates that had been closed for over 2 years had been re-opened.
This bulletin had implied that we could finally apply for "Adjustment of Status"- the final stage of the 3 step Employment based Green card process. This would solve a number of quality of life issues for people like me, as they would allow our spouses to take up part or full time jobs, they would bring in an element of stability allowing me to plan the purchase of a new home, and it would give me the freedom of relocating to another part of the USA for any unforeseen reason, without worrying about the portability of my existing job.
Therefore, my family and I worked really hard, and tried to religiously comply with all procedures laid out and submitted our application to reach the USCIS on the morning of July 2, 2007.
Besides running around to gather the paperwork to help file in time, I had to spend a significant amount of money on:
1) Urgent medical examinations and vaccinations by USCIS approved surgeon: $700. (Note: These were not covered by my medical insurance.)
2) New passport photographs; these needed to be less than a month old... so these had to be newly taken photographs
3) Notarization/ Courier charges: Approximately $100 (Some amount expended in foreign currency)
All of the money spent, as well as the time and efforts were rendered useless by the new bulletin on July 2, 2007, which I repeat, was published AFTER the window opened for new applications on the morning of July 2, 2007.
My point is, and I believe anyone with common sense would agree, it is only fair to expect a notice period before a reversal such as this one. Preferably... weeks of notice if not days! I am sure no US Citizen would accept anything less for a notice in such an important matter!
I would implore you to look into this matter as soon as you can, and request the USCIS to accept Adjustment of Status applications filed through July 2007.

more...Official Site radpaisley.com... there was a time when it used to be horizontal spillovers. i.e. remaining EB3 from other countries used to go to EB3 I/C/M, and remaining EBx from other countries used to go to EBx I/C/M. (same level to same level)
At that time EB3 I used to get around ~15K-20K, from other countries. Then all of a sudden USCIS started vertical spillover, i.e. any remaining numbers from other countries no matter what EBx, will go to EB1 I/C/M and then fall to EB2 I/C/M and then to EB3 I/C/M.
This way EB3-I gets nothing as everything is consumed at EB2-I level.
If there is a way to get USCIS to start horizontal spillover again, then things can get OK, as USCIS does not need any law change, or any legislation change for this policy.
This is incorrect. EB3 spillovers would come only to EB3 over subscribed countries. It will not goto EB1 or Eb2... But the chance of EB-3 ROW becoming current is almost next to impossible. That is why EB3-I need to depend on spillover from EB2....Since most are applying in Eb2 now, chance of EB2-I becoming current is slim....Thats why Eb3-I is between devil and deep sea.

more...Academy of Country MusicHigh number of approvals over the first few days were expected. Centers review/preadjudicate cases based on 'real' receive dates (which are close to notice dates), as physical files are sorted in that sequence. That is happening. Sept VB was available couple of weeks ago, which prepared them to issue formal approvals as soon as September starts. USCIS SOP describes that once cases are preadjudicated they are shelved (wating for visa) in sequence of PD's. Therefore, most approvals are preadjudicated cases.
Congratulations to All who got approved. Best wishes to those still counting. If you ND is not too far from published dates (i.e. it is sometime in Aug/Sep/Oct 07), and your PD is high, there is very high chance of you getting a good news soon.

My question is what will the attorneys and para legals do in the US, if they don't find sufficient cases to sustain their operation? What they studied here is not portable for other countries like software.

In theory, it is a wonderful question but in practically answer depends upon with which country you are refering the situation. In India, THE dog from USA
with hi "dogginess" certificate can project himself as "Lion". And practically I am seriously doubting the real standard of US Higher degree certification based on teh experiences so far what I have achieved working here many years. It is our problem that we take this shit to enroll in US based degree programs though you are a degree holder from India. This at least seems to be true for computer/electronics engineering related courses. It may not be true for all other courses. More or less I am beliver of the thought that this whole US education system at least for engineering and management runs on the basis of slave mentality of Indian and Chinese people. Perhaps it might be very good and of high standard 20 years back with comparision to educational systems in India/China then but now I have serious doubts.

House Speaker Dennis Hastert is backing away from statements made earlier this week suggesting a plan to hold hearings on the Senate�s version of the immigration reform bill.
According to Congressional Quarterly, Hastert says he'll look at that issue, but the first priority is spreading the leadership's message about the Iraq war. Hastert has said he wants to take a long look at the Senate's legislation before naming House conferees.
There are some big differences the conference committee will have to reconcile. The Senate's bill provides a pathway to citizenship for millions of illegal immigrants already in the country, and includes a guest-worker program. Neither is included in the House version, which focuses on tightening border security.

Format : Mp3_256I rode the nc bus to dc (ok raised funds, booked the bus, cajoled/threatened people/got permissions/negotiated deals blah blah...in partnership with ramus and gc_prasad). We started at 2 am from RTP and were in fairfax by 7:00. there were 38 people on the bus including a 2 year old. :) IV had arranged for a halt at a gurudwara in fairfax - we spent about 45 minutes there cleaning up and drinking tea. The bus dropped us off at Franconia/Springfield metro at 8:15...we took a while figuring out those metro farecard vending machines. Some of them wouldn't give us change...some others wouldn't take credit cards. But we survived. In 10 minutes, 38 people had farecards and were raring to go. We got to the monument at half past 9...and folks were already lining up, holding placards. I only had time time to meet my company brethren from Cal and then paskal. I dropped off a stack of petitions with ashish (hopefully they made it to IVs pile). The nc contingent walked together most of the way to the capitol...it was a truly great feeling, having people honk, wave and generally be nice. I could never have imagined myself out on the street, fighting against broken systems...in front of the US Capitol. But yah, it happened. During the speeches, i walked around the audience, asking folks to turn their placards to face their cameras...(something to learn for next time - thats why political events have twin sided placards - so that cameras facing the speaker get the message). After the rally, i got to one lawmaker meeting with????'s staff. They were pretty cool to talk to...while they may be aware of some broad issue with legal immigration, they seemed to fall into the "oh you are talking about h1b quota" trap. We set the framework for discussion early on and clarified the "we are talking about gcs here" point.
Some of my nc colleagues went on to meet ???? - they had a productive meeting there too...perhaps Rahul will write about it. After the meetings we made our way back to the franconia metro, had dinner at the springfield mall food court and left there by 8 pm. We were back in RTP by midnight. In all 22 hours...well spent!

one of the things I did today was send out a note to all my friends groups...while most people seemed to ignore all pleas to join the rally or contribute $, they all seemed to be watching curiously. A lot of them feared going to the rally...some others didnt care. Some others even promised to show up and didn't. But i believe we need the support of these very people, if IV has to grow and become an even stronger force in the future...I shall copy paste wot i wrote, and i encourage all to write to their skeptic friends...only to point to a positive experience and ask for their future participation. So i quote...
"Some might wonder why we participated? Well, how could we give up on a chance to make history and truly understand what it means to live in a democracy. Its not about desperation for a green card, its about fairness and dignity. We believe that we have the right to a fair, open and predictable process and anything else is an affront to our dignity. We believe that the system is broken and can be changed. But change to the system will not come overnight and it will definitely not come with us keeping quiet. So we got out and did what we knew was possible - get the message out, propose solutions, meet congressmen and appeal to people's conscience.
In participating in this movement for change, we realized something else that we would like to share. We realize that the struggle for a fair immigration process is but a process of change just like struggles against oppresion and prejudice of different severities. The only difference is that its a question of dignity and fair process versus segregated facilities and disenfranchisement. Accept one and you accept the other. So if we wonder how the world could have every been a certain way in the past, we don't have to look beyond ourselves. Honest and well intentioned as we might be, if we cannot stand up and say something about something that affects our rights and freedoms as individuals, we are saying that we are OK with all that is around us.

My i485 app was received by uscis (NSC) on 04/25, notice date 04/27. I got fingerprinting notice on may 14th to have it done on may 23 (me) and may 24(my spouse).

I am sorry to hear that VISA was not yet issued to your husband and that consulate is giving them a hard time. I pray to God that they get the VISA ASAP.
I am curious to know - if your hasband went to the consulate for the first time for VISA stamping or he had expired US VISA on his passport and a valid I-797 form and if he went for VISA restamping.
I will be travelling to my home country and will be going to US consulate for my H1B VISA stamping with approved I-797 next month. H1b VISA stamp on my passport has expired and I am here in the 8th year of H1B.

Many of us have gone through the Canadian immigration process and received permanent residence there "as a backup". It's a monumental waste of time and resources.
The several thousand dollars worth of additional (and mostly unnecessary) expense could be better spent here in the States. Something that can perhaps also be highlighted in your presentations.

Indeed, the visa process does favor white Europeans over Asians and Latinos.
My brother-in-law, who is from S. America became a Canadian citizen 3 years after he was granted residency in Canada. The decision is based on points for education, language skills, job experience, etc.
