It is mentioned by many that PD should be current at the time of GC approval. Is that right?
I know people from India who got their GC approved when their PD is not current.
One can check this easily in looking for I-485 approvals to people from India who submitted their applications concurrently in EB2 category after say april 2004. Disregard the cases which got approved in July 2007. Still there are many cases remaining invalidating the 'rule'!

The strict rule is that one's PD needs to be current for approval. But if there aren't earlier PDs available for approval ( say stuck in namecheck ) and if USCIS doesn't want to visa numbers for a year to be wasted , then one can get approved even if PD is not current.

As all PD are now current, number of EAD filling will increase. So the processing time will be about 6 months for EAD.
My question is what will happen, if the PD retrogress before EAD is approved. Will it be still approved, or will have to wait till PD get current again.

Thanks for reply. I updated my profile. I just want to know there is going to be only 10 days gap between joining date of new employment and renewal of new EAD, will it create a problem.

ATA conf is a popular event among South Indian (Telugu) immigrants - this year their meeting is in NJ. During this even they seems to have an immigration forum with Attorney Murthy - details are below. If enough IV members are attending - it will be a good idea to have an informal meeting among ourselves. you can file for a change of status to H-1, but you cannot begin working until the change of status is approved. Alternatively, you can travel to a US Consul, obtain an H-1 visa, re-enter the US using the H-1 visa and then begin work.

I need to re-file my I-485 application which was rejected due to USCIS error (they could not find I-140).

Can anybody tell me what is the logic behind writing "DO NOT OPEN IN THE MAIL ROOM" on envelope while re-submitting I-485 appplication?

Yes it seems USCIS is also asking the public to help improve its website. It has posted a link on its homepage "Help improve uscis.gov" which was supposed to take you to another page. Unfortunately that link is broken as of now. If you click on it, it takes you to a blank page.

Applied for EAD renewal on 6/11/2008. Should I get it for 2 years or 1 year.
My understanding is everything that gets processed after 6/30/2008, will be for 2 years.

My PD is 6/12/2006, EB2 - which is not current right now, and I don't expect it to be current, until my I-765 gets processed (Well if it becomes current I guess I don't need 2 years :) )

Can we ask for a new legislation that will allow for complete portabilty after i-140 approval? If this is achieved I don't think retrogression/insufficient Visa#'s would be a big deal.

It may be better to call the USCIS 800 number and I think there is an option for change of address.
