As you mentioned that I need to apply the transfer through a Lawyer, I am little confused.

My consulting company with whom my H1B exists and to which my wife's H1B to H4 transfer is planned, have sent me the required documents "I539, Application to Extend/Change Non-immigrant Status" and asked me to send them to USCIS myself.
Is this fine ?

My employer filed labor for me in October 2007. My labour got approved in Feb 2008. Can you please know when I can apply for the EAD? What are the pre-requisties to apply for an EAD.

So does it mean if 140 is approved in TSC, we can file 485 to TSC even before 7.30?

As far as I know both the client and vendor letters should state the same and it is good if you have it for 3years.

At least see if your manager is willing to give you the letter on company letter head.

You must be actually in H-1B status in order to use the H-1B portability provisions. This is what allows you to start with Company B once their H-1B petition is filed, rather than wait until the petition is approved. To use this, you need to get into H-1B status for Company A 9either through a COS petition or by entering the US in H-1B status. I don't recommend that latter option if you know that you will be changing employers as soon as you enter the US.

Alternatively, you could change from Co. A L-1 to Co. B H-1B, but you cannot start working for Co. B till the COS is approved.

I am currently on H1B with an employer who has processed GC so far (labor and 140 are approved)

Currently I have all documents except
1)Approved 140
2) Employement offer letter

For 140, I have courtesy copy.

Employer is asking lot of money to file 485 all of a sudden. And they are not responding to my calls for offer letter.

So I was planning to apply 485 by myself or hire an attorney other than my company's.

Since I dont have above mentioned documents, can I still apply 485 without being denied?

I got my Finger Printing notice today and I was comparing it with the 485 receipt. The 485 receipt had A# as A9xxxxxxx ( A with 8 digits) as the receipt number while the FP notice had A09xxxxxxx as the number.

The FP notice has a "0" after the "A" and the 485 notice does not have that 0. All the digits are the same but for the 0. Any one has it similar. do i need to worry abt it? any suggestions? You think i need to get it corrected?

I applied on July2nd, I got the receipts on september7th and FP for oct23rd but no EAD yet! I have seen most of them get EAD but no FP, Does it matter which comes first should I wait sometime after FP for EAD?

My employer has asked me to take care of our office in India. I am on H1B that will expire in 2011. We have decided for me to spend 2 months in India and one month in US. The plan is to reenter US on H1B since it will still be valid.
I also have a pending 485 and i am going to let my EAD and AP timeout and stick to H1B.

Now, the question is: will this be a problem? Is there a limitation on how long an H1B holder stay outside the US while continuing to maintain status?

I am going to be travelling back to India soon but have already spent more than 5 months in india this year (onver three trips) and am wondering if there will be a problem when i come back in november.

I cant find anything on the net no this.

There is no problem. I had to do it for same reason i had to work 2-3 months in 2 instances. And for the final time, it was 15 month offshore India assignment. No problems at all.

One of my friends applied for his GC thru a consulting company which he does not work for...He used to work for the company but left that company before he decided to file with them...Since he has good relations with the company, they decided to file for him.
The company recently filed his I140 but they got a RFE on I140. INS wants to know why does the company want to hire him and why he left the company in the first place..does anyone in the forum has a similar experience to share...The RFE is actually for the conmpany but the owner wants my friend to write a letter and mail it to the lawyer. Any help is appreciated.

I am on H1 visa. 485 pending, and have EAD. However the 1 yr period of EAD is nearing, the EAD expiry date is Aug 20. We have already applied for EAD renewal and have recieved 'notice of receipt' for the application.

My question is can I use EAD and change job while EAD renewail is in process? The problem is that the current employer may be closing this dept in few weeks and therefore, I will be losing this job. I would like to know if i can join a new job while EAD renewal is in progress.

You can, for the duration of your current EAD. If you get your new EAD before that, then everything is fine. If not, you might have to stop working on the expiry date of your current EAD till you get the new one.

In the 485 check list sent by my employer one of the item is :

"Affidavit of support duly notarized (Form I-864) if you are applying for your family"

I am applying for my self and my wife and for my daugher. I will send my all paper to my employer and he will sent to attorney.
Do i have to fill form I-864 or attorney will fill form. if i need to fill then where i can find this form and how i can notarize it.

I believe it should be okay.

Make sure you get a copy of the advertisement and a copy of the link that it points to which has all the details. Make sure when you print it, it has the website link printed in the footer or header.

Sorry you cannot claim. You have been a resident of GA, so rent/meals/commutation/laundry cannot be claimed as deductions in Tax return. You never had a home in NY/NJ. You will surely be a RED flag for IRS. Dont do wrong things to get some money. State the truth and be satisfied of the tax return you get.

However, you can surely ask your employer to give a part of your salary as expense reimbursement, which is legal.

Trust me, you get more tax return here in US, than in India.

Just get a letter addressed to Consular Office, US Consulate , City ( where your wife is scheduled for interview) . In the letter just mention in subject line "request to grant visa to spouse of Mr XXX" and in body just mention the details like Mr XXX is working with us since DATE As DESIGNATION and his salary is $XXXX. We request you to please grant his spouse Mrs XXX H4 visa so that she can join her husband in USA.

By chance, I was browsing the USCIS homepage when I came across guidelines for the change of address form. It says that not changing your address within 10 days is a criminal misdemeanor. Does anyone know when this law was passed?

As long as they have valid visa, there should not be any problem entering after short gap outside USA.

I guess IO can object if this happens very frequently but in that case they will warn first rather than taking other action.
