Is it true that they really approved 60000 cases in June. I have a couple of friends that filed I-485 in 2005 and there background is clear too but still have not been approved. I don't understand what is going inside the blackbox. I read in forum that only 40,000 application were ready for approval but then why didn't these people application was not approved all thou there file was complete.

My wife (H4) & I (H1-B) have valid I94 and visa stamped in out passport for company A until AUG2010.Last September 2008, I have transferred my H1-B to Company B and it got approved and valid until same AUG 2010.Right now I am working for Company B on H1B

When I moved to company B, My previous employer canceled my I140 that triggered 485 denied (For Both).Worked with a Lawyer and filed MTR and my (I am the primary applicant)MTR got approved back in Nov2008.I am still waiting for my wife MTR update. Online status still shows - Case received and pending. (For MTR)

1) I am thinking of transfer my wife H4 to Company B. Is there any issue you guys (seniors) think of?

2) One more question .We both has EAD valid until 09/2010. Both never used EAD. We got our EAD before our 485 denied. Now since my MTR got approved, the EAD is still valid?

It depends on which state you are in and where your labor was filed. No matter where you send your application there is a possibility that they can transfer it to another center. I sent mine to NSC and it was transfered to Texas.

Yes there is away to track your 140.

Goto https://egov.immigration.gov/cris/jsps/index.jsp and create your profile and you will be able to track the process. THere is option to receive email from USCIS whenever there is a change in your file (you have to select that option)

I am not sure if its a new rule to get an NOC from the husband, but as far as i know NOC is required only for Govt Employees. Make sure you really need one for getting a passport for an individual. If your wife is a Govt Employee then she may need one from the Govt/Office where she works.

I think NSC is still following the EAD processing date unlike TSC which approves EAD application during "receipting".

I had filed for my I485 on 19th July at Nebraska. My 90 days are getting over on 19th Oct. Still I have not received any receipts for I-485,EAD,I-131.
My lawyer is going to call USCIS to inquire about my case.
Does any one had experience calling USCIS after 90 days were over and the USCIS tracked your application and you got your receipts.
Would be great if any one can share there experiences.

Some where in May I heard the news that end of this year USCIS is going to halt concurrent filing of I-140 and I485 and introduce an extra step called preApp of I485 which can be done only after an I40 approval. I would like to know if this is really going to happen?

I have an approved I140 and a PD of Apr 08. I am planning to change the company now. My doubts are
1) Suppose if USCIS changes rules and introduce an extra step for preapp of I485.
What will happen if I switch company after 180 days of preapp of 485. can I invoke Ac21 ?
2) will I be eligible for EAD/Parole after preapp of 485?

Any body having any knowledge about this please share.

I filed for H1 petition in August 2009 and it is still pending. Meanwhile I applied for another H1B through a new employer (new employer took over my previous employers business) with premium processing. My latest H1B petition is denied citing Employee-Employer relationship discrepancies.

My attorney basically submitted documents similar to what he did for all other employees but they all got approved. I dont know what went wrong in my case.

I have a Master degree in Computer Engineering from a reputed school in this country as well. Please tell me what my options are to get back into H1B status and start working again.

My attorney has filed our AOS on July 30th. She didnt had time foR filing our EAD & AP. So I'm applying myself.
My wife was out of status and is under 180 days. Her AOS will be considered under 245(k).
Now to file her EAD & AP, do I need to attach any Cover letter explaining her status? or the documents that are required will be sufficient? Please some one throw some light and let me know how to proceed.

I guess in the facing rapidly declining ratings, Mr. Dobbs is resorting to even more extreme rhetoric and has now joined the "birthers" desperately peddling one of the sillier conspiracy theories out there. While it showed weak moral stamina, I could at least understand the economic reasoning behind CNN keeping Dobbs on the air when his show was producing healthy ratings. But even that justification for leaving him in prime time has evaporated. It's time to pull the plug. Hat tip to George C....

I have a quick question. My I140 got approved in sep'08. Should I have to wait till PD gets current or I can file for I485 and USCIS will process my application according to my PD?

Any responce will be highly appreciated.

I filed my I-485 application with vermont and I live in WA, according to the instruction form , I765 should be sent to Nebraska

1. Where should I send the paper filing for EAD ot Nebraska or Vermont.
2. Should I make the check payable to USCIS or Department of Homeland security.

Forgot to mention this is AOS case that was transferred. My AP renewal is still sitting in TSC.
