While photographing in the Japanese garden in Portland, OR, I unintentionally captured most, if not all, of the stone lanterns that are dispersed throughout the grounds. Here are my three favorites. More in my gallery. Comments appreciated.

The events get called correctly but nothing is drawn.. help? thnx

Can we file I-765 (EAD) and not use it? Do we have to renew it even though we dont use it?

Thanks buddy. i was referring to other programs that have been discussing the same. The point is: The issue is gaining visibility.

I think you can apply for reinstatement from within U.S. Check with the International Students Office at your school.

H4- EAD impacts

break it down by 3 levels.

1. minimum wage
2. Average wage as per DOL's SOC code
3. Average wage based on education and skill level

Well they may created it new but the content is old and system needs to be fixed.

My main worry is that since I dont have a copy of the I-140 approval from old employer, Is there a way the new employer can ask USCIS to look up that case(I have a copy of the receipt)?

My employer sent the documents for my H1b extension today to USCIS and they applied it through premium process, can anyone please let me know how many days it will take to get the Receipt notice both in Email and hardcopy?

My H1b expires on Dec 15th 2010 and if I wont get my receipt notice by than can I stay in US legally or should I have to leave US?

Please let me know your suggestion.

You will get the acknowledgment within 3 to 4 days of receipt.
If you do not get receipt, then you are out of status and will have to leave the country. But don't worry you will have the receipt before Dec 15. BTW which center did you apply to?

And what if filed a concurrent I-140 and I-485.
Though this is my second I-140 and I am trying to capture an old priority date (and I do have the receipt from the old I-140).

I have been looking topics like this one. Does anybody know if H-1 H-4 can apply for financial aid? does it come up during GC process as goverment aid and therefore could put you GC approval in danger of being rejected? I read somewhere a list of federal help we can use and be OK. Does someone know where to find info?. I have a daighter H-4 who starts college this year. She qualifies for in state tuiton. Does this affect her GC process? You never know when issues like this will surface along your process. I don't want to make any mistakes. Is someone in similar situation?

I filled the DS160 and took an appointment at US consulate yesterday night with out the photograph. Looks like we can submit the photograph along with the confirmation letter on the day of interview.

I thought we needed to upload the photograph for completing DS160 but that does not seem to be the case. Did any of you experience this?

Indeed. 140s are getting a lot of RFEs nowadays and are once again taking nearly a year. It is a brave soul that will avail themselves of the AC21 180 portability provision without an approved 140 petition.
The main points are the following, if you get an RFE and it has anything to do with your employer eg. ability to pay etc, can you count on them to send in that paperwork. If your employer withdraws the 140 application then you are left without a plank to stand on for your 485 as well.
Basically you are on very thin ice if you invoke AC21 absent an approved 140. If you are contemplating such a move, you should atleast consider doing it on a H1b visa as back up.
These are my views, please consult an attorney.

My wife is scheduled to appear for fingerprinting at 1 om a future scheduled date. However I learned from someone that she can go for the fingerprinting even earlier in the day and she will be fine. Is this true? Has anyone experienced this?

I have tried this when i went for my finger printing for my EAD. My interview was in afternoon and went around 8:30am and they did allow me.

Concurrent H-1Bs have no quota restriction. You just have to mention hourly rate and number of hours per week for the second job.

I have a (hopefully ) simple question:

I am EB2 (had been current the whole time) and I am just now ready to file my I-140 and I-485.

That said and considering the now new window to file (till 8/17), should I premium process the I-140? Does it even matter? Am I going to basically throw away $1000?

I had ready that they would not even touch the I-485 till the I-140 was approved but that sounds like a contradiction to concurrent filing, right?

Any info, tips would be greatly appreciated.



My attorney is ready to file but I want to make sure I ask the right questions/get the right info from them before they do so.

That's right, premium processing has been suspended. Yes it is true i-485 is not touched until i-140 is approved, but they will process EAD and AP. They just cannot decide the i-485 BCOS it is based on an immigrant petition. IF the immigrant petition has not been decided, they cannot do anything about the i-485. Hope this helps
