I know man.. These people are going bonkers right now. They know whats coming down the line after 6 or 7 months.

TSC USCIS Receipt Date 07/08/2008
Card Production Ordered Date: 09/02/2008.

There was no LUDs all the way and they did not ask me to do FPs. FPs were done in 10/2007 for I485.

I received 2-emails one 9/5 and one on 9/9 with the same message saying my EAD card production Ordered. I don't know why they have sent 2 emails.

I am still waiting for my wife's approval. Even though we applied on same day.

I actually spoke to Customer service and I got 2 very different responses.

1. Wait till you are an old man and then the cards may just come !! (Just Kidding ) she actually said wait for 90 days.

2. Another CSR told me that the TSC is having technical issues and they are not able to access the Biometric information on approved 485's in their systems. She advised me to download Form I-90 from the USCIS site and fill that in and send it in - if you have a minor on the petition then also send 2 passport size pictures of the minor - this will allow them to access the Biometric screen when they process the I-90. We will get Biometric notices and the Minor will get the card - the Grown ups will get the Cards after the Biometrics are uploaded.

I have not done this - eventhough I downloaded the I-90 forms - I took a INFOPASS appt and if they suggest that I should do a I-90 then I can get that done right on the spot - I am carrying the filled I-90 with me. Anyhow I-90 is usually submitted to correct errors on the card or to replace a card - however this woman sounded quite knowledgeable - but then there are issues realted to where the I-90 should be sent - this is specially complicated if your case has been transferred a few times like mine was.

Best is to check with the guys/gals at Infopass -meeting.

All this was from the rep at the TSC - so not sure if this is applicable to all centers.

AGAIN THIS IS WHAT I HEARD FROM THE TSC REP - PLEASE USE THIS INFORMATION AT YOUR OWN RISK - I AM NOT SENDING THE I-90 ON MY OWN.

Agreed it is the state dept not uscis.

We should not mix the interpretation of eb2/3 visas with other immigrant visas including other eb due to perm.

Could Please ask the lawyer this following question about statedept eb2/3 visa allocation to non-perm derivatives ?

The employer petitions for 1 permanent-employee. With assurance that the 1 person doesn’t displace local workforce (existing citizen and gc). How come state department allocates additional visa (more than approved) to derivative(s) who is not "perm labor certified" from a quota/poll (eb2/3) that mandates labor market test like perm ? (while the actual qualification is fb2a)

* State department also burns the eb2/3 visa allocated for US-businesses to bring in much needed skilled eb2/3 labor ? while most real primaries wait, the visa gets allocated to non-productive derivatives ?

Is state dept making mistake ?

He said
INA Sec 203 talks only about the eligibility to apply the I-485. But the visa number is derived from a relationship to Principal applicant of green card. This is true for all categories Including investor, asylum, Employment categories. Please note that It is Dept of State that is responsible for this allocation not USCIS.

My PD is Dec 2004. I am hoping in 2010.

Mine is Nov 2005... and I am not hoping. There is no point in hoping or fantasizing etc. Just forget it. :mad:

Please do find if U need permission from local law enforcement before holding the protest.

When some one decides to apply AC21 by having an offer from another employer, it is not clear if one is required to inform USCIS about it. Some say one should, others say, not required. Has anyone seen any USCIS position on it? If not, perhaps we should make this as a question for next Ombudsman's conference call.

Good suggestion for bringing this to Ombudsman. BUt anyway informing USCIS would be the wise step in a sense you will not invite unforseen problems may be associated with not informing.

It was kind of a shock to me. I pray the god for the better, please consult more sources for any cure. I know one place in Karnataka, where my uncle got cured his cancer. I will try to get you the details ASAP.

I hope I had got answer to this question ? I am still searching and been doing for last 2 1/2 years from the time I joined IV.

This is pathetic ... And it's time for most of you to seriously think about converting to EB2. Now I have no idea how difficult or immpossible this would be, as I had always been EB2, but their are several threads on this forum that can assist you. I strongly suggest you to seriously start researching your way out of this mess. I wan't expecting EB2 to stay beyond 05, but it is going to be like that for another month. Are all the 2004 EB2-I applicants exhausted? ... I don't know, but I know EB3 just keeps on retrogressing.

If this abyss continues, think about it ... you will always remain struck where you had been for past so many years. This is no life.

Ask yourselves ... how can I convert to EB2. Take control!


For people like me with 3-Year degree EB2 is not an option. The only option I see is Investor Route...

Lawyer sent to NSC on 27th July. Today called to USCIS support. There are no receipts numbers in the system. What could be the reason.

Case might have got transferred to CSC. I applied on Jul' 23rd and no news yet.

Application was received on July 12th. No cheques cashed and no receipts!

My case was received by NSC on Jun 25th. No word yet. My I-140 is from Texas. Very worrying situation,


Don't worry.. you will be fine. you will receipt from TSC in day or two
our application reached NSC on 22 june and cheque cashed yesterday. wait for one or two day, you will get good news

IMHO, you are wrong about the "least resistance" part. Who told you that there is least resistance to change/remove country quota? How did you come to that conclusion?

This guy is a deshi employer. He is on H1 so he is a silent partner & that why scratching his head.

There are attorneys who will charge only after recovering money. The stupid employer can be sued for lost wages along with civil penalties from which the attorney's fee will be paid.

I just read first page of this thread and would advice that don't follow most of reply because they are lawyers or they have not gone through the experience you are going through. $4000 may not be big amount compared to hassle of law suite , piece of mind or the amount of increase you may have received by switching employer. I know a close person who had gone through exactly same situation in NJ and had to pay 12,000 to settle the case. I have seen bunch of people in same situation and my friend always adviced them to stay away from law suite. If your current employer is not big then there are greater chances that it will turn away from you in case of law suite.

If you are not working with same client that you were working when you were in company A then non-compete may not hold against you.

Also can you get in writing from you current employer that they will support you in case of law suite?

If receipting update as of 8/24 is correct, they should be doing late July now.

While I work as senior software/application developer in my current role with the same employer who filed my LC and GC.

Now I am getting an offer from another employer with same title "Senior Software Engineer".
Is it advisable to change job as my job code (job description) might be different from the one that was mentioned in LC?
