Golden Temple TheI think that it was a trial balloon. I have seen this pattern for most of the major issues this administration is planning to tackle. Take TARP for example...for a month one would just hear leaks about proposed solutions. Media would pick it up and give a reaction, the next leak would be an updated version based on the feedback. Such articles help keep the issue in the forefront, help gauge the reaction (both positive and negative) and provide a simple exit to backtrack incase of major opposition.
A picture from golden guardsHi All,
I would like my parents and my younger brother who is in his engineering college 2 nd yr to visit me on visitor visa. My father is a government emoployee with more than a yr job left, my mother has retired last yr and my brother has still 2yrs left for his engineering.
1. Do you think they should raise any objection for my brother getting a tourist visa ?
2. Should my brother's case affect my parent's case as well? I think given my father is a govt employee in India, that should work in his favor? Any thoughts.
Thanks in advance,
Get Visa for your brother is a dream . Your parents should get with out any issues . I would suggest dont even try foryour brother as this will be enetered in passport and can cause issues in future

more...hot to the Golden TempleI have a curious situation. I have filed EB3-485 as a secondary applicant to my wife. I am currently in a job where I can't file a green card ( this is my 5th year of H1b). My understanding is one can't have a seventh year extension for H1b unless his I-140 is approved.
Should I consider changing the job and filing another GC by myself. I know I can continue renewing EAD but I still want to keep my H1b
Thanks
If you want to keep your H1-B beyond 6 years, I dont think you have any other option! You have to have your own LC>365 days or approved I140.

I recently made the move to digital by purchasing a D70. I'm interested in purchasing the Nikon SC-29 cord for use with a SB-800 on a Stroboframe quick-flip frame. I like the idea of the added flexibility that the SC-29 gives over the SC-28 because of the additional autofocus lamp.
However, after I ordered the SC-29 from Etronics.com (who listed this product as being in stock), they contacted me a day later to say that it was actually out of stock. Furthermore, they said that Nikon had discontinued the product, and that though they tried, they were not able to obtain one of these cables through another channel.
Has anyone heard about Nikon canceling the SC-29? That doesn't make any sense to me. I've seen these for sale on e-bay, but that is through a Japanese reseller, and the shipping takes a couple of weeks (not to mention, it's not an authorized Nikon USA dealer).
Any other information or input about the SC-29?
Thanks so much!

Health Secretary Jose Angel Cordova said Mexico's confirmed swine flu cases jumped to 473, including the 19 deaths. The previous death toll in Mexico was 16. A Mexican toddler also died in Texas days ago, for a worldwide total of 20.
In accordance with measures announced by the Government of Mexico to limit the congregation of large crowds to prevent the spread of the H1N1 virus, the U.S. Embassy in Mexico City and the U.S. Consulate General in Ciudad Juarez advise that most consular services are being suspended. The dates listed below may change. The Embassy and Consulate General will monitor the H1N1 situation continuously during the week and will update information on our website if the dates of the suspension of service change.
Immigrant Visa operations in Ciudad Juarez have been suspended from April 30 to May 8. Immigrant visa and waiver applicants who have April 29 appointments should proceed to the Consulate. The panel physicians are closed. Those applicants who have consular immigrant visa appointments after May 8 and have not yet obtained their medical exams should not come to Juarez until the panel physicians have re-opened.
All non-immigrant visas operations in Mexico have been suspended until May 6.
Consular services for U.S. citizens throughout Mexico will be limited to emergency assistance and to citizenship applications (passports and consular reports of birth abroad, or CRBA). Anyone with passport or CRBA appointments are encouraged but not required to reschedule to a later date. Inside the Harimandir SahibPriority Date: Jan 2006
Category: EB3
I-140 Approved: Aug 2006
I-485 Filled: July 2007
I have a new job offer and the employer is willing to sponsor my GC in EB2 category. The job requires BS+5 years experience which I have.
Question: If the old employer revokes my I-140 before the new employer files new PERM and I-140 under EB2 category, can I still port my EB3 priority date to EB2?

Kushal nager,Inside goldenGenerally attorneys charge a retainer fee. What that means is they are willing to represent you regarding any issues with a case. Some services are covered with retainer fee and they may charge additional fee based on any extra work. For Example AC21 Retainer fee is around 750/- where they submit a G28. Then for any RFE they generally charge in the range of 250$.
Thanks for the reply. I understand the retainer fee but I guess what bothers me is why the attorney wasn't up front about the situation or simply charge for a consult then going ahead with a retainer when we simply thought there was something more involve to do with my case at the time.
Its the way that the situation was manipulated to get us to retain this attorney for further use when at the time it wasn't needed that feels fraudulent.
Thanks again!

dresses The Golden Temple ofImmigration Visa Attorney Blog Has Just Posted the Following:
No, not the Michael Jackson, This is It. This is it for FY 2009 H-1B season. USCIS states that as of December 15, approximately 64,200 cases have been filed. That leaves about 800 slots left for H-1B applicants and perhaps several hundred on top of that since USCIS will need to account for potential denials or revocations of previously filed H-1B applications.
Back on April 1, 2009, a lot of speculation was made about how fast or slowly the H-1B quota would fill. Predictions from one day to 6 months were made. But it looks a lot clearer now... by Christmas or maybe, by the New Year. There really is no way to tell. Practitioners who focus on H-1B work like me, know that odds look dim for someone seeking a new H-1B and who hasn't started the process yet. Issues of delayed LCAs (labor condition applications) and employer FEIN (federal employer ID numbers) are wreaking havoc on how quickly anyone can prepare a new application to get in on this year's quota.
If you have not been able to file an H-1B yet. Call us about planning your case for April 1, 2010. It's never too early, but it can be too late. ---ecf

But the July 2nd decision was reversed later. Why did they not file then?
Besides, companies do not need to pay for 485. Makes no sense for them to pay for something that they do not have to.
On a separate note, does anyone know of any company which has discontinued GC processing because the new rule states the employer has to pay for PERM?
That's our company policy(1 year bond of course)
BTW they did file after July17th.:o

I recently did apply for EAD and the documents required are as below
1. Personal check or Money order for 380$. I prefer sending personal check so that i can know if my check was cashed.
2. I did paper filing and not e-Filing. Some say efile is better some say paper filing is better , i felt paper filing is easy and better , as we can track our documents sent.
3. Docs req are
1. Filled EAD Application form
2. your 485 receipt notice copy
3. Current Addresss proof. electricity bill, water bill etc.
3.Copy of the biographic page of passport for each applicant
4. i-94 Copy
5. 2 Photographs
6. SSN copy ( i put it as my attorney suggested but its not mandatory)
7. copy of driver licence
With e-file too, they instantly cash your payment via credit card or debit card. So, you can keep track of it.
