I just got my FP notices which were returned to USCIS as undeliverable as I changed address. They mailed the same notice back with the old envelope (with post office label saying undeliverable - cannot forward as return service requested).

They send the same notice back. They didnot reschedule my FP appoitnment. I am glad they did not because after I missed my appt my attorney got a copy and then went in a walk-in and got my FP done...I was worried as my inquiry about missing FP notices might have made them send a new notice with a new appoitnment date.. I am glad they checked the system and saw that my Fing prints are already in the system....

In your case, it might any of the returned notices....

My wife has worked on a project and got some money on 1099. and as I said earlier that she has taken SSN based upon her EAD.

Does it mean that she has started using EAD ?

and now her H4 is invalid ?

I have got all copies of my labor, I-140 etc. and it has been more than 180 days that I have got my EAD. Do I need anything else from my old employer ?

NIW 140 approved last year. EB1a 140 RFE/485 pending. Can I file a new 485 for NIW? or do I have to withdraw the pending 485 before filing the new 485?

I am in similar boat. What does your lawyer say? I am waiting for my lawyer response. How about option on interfiling NIW 140 with the pending I-485. That is do not file new I-485 but change underlined I-140 in the old one. Ask your lawyer about that and let us also know whats his/her response.

You maintain H-1B status as long as there is a relationship between u and ur company. This is usually showed by paystubs. If you do not, you can apply for H-1B transfer, but then the extension of stay will most likely not be granted, as the USCIS needs to see your paystubs. I would speak to an attorney about this.

But do most people HAVE the PD on the receipts, or not? What is the usual procedure followed by USCIS?


It is normal not to have PD on the receipts.

USCIS record shows my entry year 2003 but actual year is 2005, so they came back saying 6 years is complete. Lawyer provided all the documents to prove I am here only from 2005...

I dont see any rule set for AP renewals..But on a safer side 120 days in advance and based on your travel needs..

My Scenario

-> I entered country on B1 and I applied for H1 through other employer. H1 got approved but change of status is denied as i left the country while petition was with USCIS.

-> I entered country on B1 again with new employer who applied my H1. My I94 validity ended on October 24th and we applied for extension due to some show stopper. Application is still in process.

Here are my questions -

1. Can i apply for change of status now or do i need to go back to India?

2. Now that i applied for extension, if i go for stamping at India immediately, will it be positive? Just because, i stayed for almost around 8 months in US this year. I was just wondering, will they reject it raising doubts on my intent? No one can decide on it, but what are the chances?

3. Staying in Canada on work permit for 6 months and then leaving to India for 3 months and then go for stamping, is this a better option?

You need a professional advise as employer haven't paid proper professional attention while filling PERM.

I am going to Chennai for my visa stamping and the consulate website says that I need to present the " complete I-129 petition submitted by your prospective employer including the Labor Condition Application " during the interview. Can any one tell me if the photocopy of those documents will do or do I really need to carry the originals (which I don't have)?

clearing the cookies resolved the issue. On the second visit issue reappears again.

I see another issue/bug with IV. I have been observing this for a long time.

Though one particular thread shows 102 pages, the maximum I can go is 98th page. I think somehow the page counting logic is wrong.

My interview went fine. I got the H1 stamping done today at hyd counselate. The interview was pretty short. I showed him all the important certificates ( Passport + petition + Hdfc fee slip + DS forms ). Then he asked me the following questions:
Why do I want to go to US?
where I am working?
How long have I been working?
What do I do in my job?

APPROVED!

This is my number -- **********. If u have any question give me a call. This number is valid till april10th... after that I will be in US.

I work in a semiconductor company and got laid off last week. My company informed me that they will inform INS to cancel my H1B in May. I plan to go back to school and change my status to F1. My question is, to do a change of status from H1 to F1, will they ask my recent pay stubs? Please reply

I think you should wait until you get your new approved EAD.

How come the company who is taking you didn't ask for unexpired EAD???
