I am new to this thread. I have a bachelor degree in Applied Science in IT and got it in about 1 and half years because I got an points exemption from my advance diploma. I also have 7 years of IT working experience and currently hold a H1B1 visa. H1B1 and H1B are not the same thing. The question is can I apply for my GC in eb2 category?

I've seen people getting the GC Approvals even though their PD is not current. But close to current published dates.

The data is incorrect. There are a lot of applications not accounted for. See Ron's posts whee the lawyer has done analysis and said that.

I have a very complicated case, and I need some answer that can release me from all this stress.

I came to the United States country in 2007 with a F1 visa. I won a scholarship sponsored by the government of my country to complete a bachelor degree. I was sent to a community college to improve my English skills. I finished my associated degree at the community College last spring 2009. Since my school only issued the I-20 until June 2009, my visa was also issue until that date. Therefore, my visa is already expired. However, already got accepted into a 4 year college and I am starting in Fall 2009, so I am still under F1 status.

The institution that is sponsoring my scholarship agreed to pay for my bachelor. However, they are requesting all scholarship students to change their status to j1 by the beginning of spring 2010. If I don't do it, I will lose my scholarship and therefore my status since I don't enough money to pay for the very expensive tuition. The institution wants us to go back for two years after we finish our bachelor, so they forcing us to change our visas.

I have been living with my girlfriend since last year. She is a Permanent Resident since 2003 . She is planning to apply for citizenship on February 2010. We are planning to get married by the end of this month (August). I need to go back to my country to change my status to j1 by the end of the fall semester, so I can keep my scholarship.
Here are my questions:
Might getting married now increase the risk of been rejected when apply for J 1 visa?

When would be the best time to get married?

When would be the best time to apply for green card? (Summit I-130, I-485, I-765 and G-325)

My fiancee and I don't have any problems with me going back for 2 years after I finish my studies, as long as I come to visit her about 3 or 4 times in the period of 2 years.

My I-485 was filed in month of August 2008 under EB2 .I was laid off from my I-485 sponsoring employer(A) in month of August 09 and i took another Job with employer (B) in same field in month of Sep 09. I did not file AC21 as my previous employer's(A) attorney advised not necessary to file AC21.Now I am getting new offer from another employer(C) in same position but this new employer(C) wants me to file AC21 .

What are my options now? Should i file AC21 for employer (B) first and then file AC21 for employer (C) or should i directly file AC21 for employer (C).

I will greatly appreciate your reply.

I think it is better. Your EAD and AP will be processed faster because they are in CSC and your I-485 is in TSC, which is better than NSC.

Can somebody provode me list of H-1 sponsoring consultants in non-IT field?

It depends on how many cases that will be pending approval on October after the surge of applications this July and August.

I think it wouldn't be current for some countries specifically India and China.

My attorney had the same text in my G28, I asked him the same question. It is fine, nothing to worry about.

My company filed my 7th year H1 extension and my wife's H4 petition at the same time in Dec 2006. USCIS online case status shows received and in process for both H1 and H4.

Recently, we upgraded to premium processing. However, only the H1 case status now shows as being done under premium processing. Does that mean that only my H1 will be premium processed and not H4 even though they both were filed together. Is this normal. I am hoping both H1 and H4 will be premium processed. I know that USCIS adjudicates H4 also in premium processing for such cases as a courtesy. Just wanted to know if anyone has been under similar situation before and got only their H1 approved in premium and not H4....The whole purpose of me upgrading to PP was to get H4 approved before the H1 quota begins in April as our H1/H4 were expiring this summer and my wife's employer is filing a H1 COS petition for her in PP under the 2008 H1 quota....Didn't want to take any chance of her H1 COS getting approved without a I-94 because of her current H4 expiring in summer.

As I understand the process, if your date is current, the USCIS will accept your application - meaning they ARE processing applications with a priority date matching or exceeding yours.

During the July 2007 fiasco, the cut-off dates were current, allowing everyone to apply. If we submitted our application and the date is current at the time, why do we have to wait until our date becomes current again? Shouldn't they process the application within 6 months or less?

You application will continue to be processed when it is within the processing time - visa allocation happens only when your PD is current, which apparently is not. Moreover - Visa Bulletin is just a Forecast based on current demand so, actuals can vary at any time. There is so much to read about this in many forums including this, so you may want do more research before asking - I have a reason to tell you this because your poor soul will soon be hounded by GURUS for not researching enough :-) Hope you understand!

You may as well ask uscis to ask for the remainder of the H1B period provided there is an employer who is willing to process your H1B. Remember, you will have to lose your current I485 processing and start all the way from scratch though you can recapture the priority date with the new GC process.

have your friend look or ask for where the nearest USCIS office is with a deferred inspection office. they can fix it there.
