I did contemplate not filing for AP and keeping h1 and infact planned to get stamping; but after long thoughts i let it go. I figured not filing AP is not worth the risk.

IMO you should get AP and then travel, you sure can go for h1 stamping.

1. Can someone please let me know what I should take with me when I meet the USCIS civil surgeon? Who gives the Form - I-693? My lawyer has not attached that form in her mails to me? Does the hospital provide or should I take one with me myself?

2. How is the procedure usually with the USCIS civil Surgeon? What does the surgeon do and how is the examination like?

Please help me understand this process better. I am aware of the vaccinations I should take but I am not aware of the procedure with the surgeons.

4. Consult an immigration lawyer ASAP

Today, My H1B transfer got denied and waiting for denial notice. Employer is planning to appeal on denial case. (I am assuming that "Denial could be becasue of client letter was not furnished)

My Layer: Employer->Company A-> Primary Vendor -> Client

My I-94 is valid Nov-09-2009 based on previous employer petition. Previous employer notified USCIS on H1B termination.

On this, What would be best option.

1. File a new H1B case thru current employer (while is waiting for appeal result, as a back up plan)?

2. can I continue work for current employer since my I-94 is valid till 11/09/2009 and filling MTR?

3. Apply for H1B transfer thru primary vendor's sister concern?

I saw that too, but my problem is that i already had an appt for 3rd week of dec but I had an issue with my passport. Had to send papers for getting my name changed to my married name on the passport as the latest I797 i received was on my married name (noticed this only recently). Now I cannot change the name, passport etc on an existing appointment so will have to cancel the one I have. And currently only emergency appts are available for 3rd and 4th week of dec. Hence the dilemma!!!!!

Could you please search archives. In the past I had written about these issues and members had discussed this issue.

Request for Change of Status means that you are physically present in US and requesting a change in your immigration status, in your case from F1 to H1. However if you leave the country when COS is pending, your COS application is considered abandoned as it is assumed that you'll re-enter using the status that you desire.

Hence your H1 is approved, COS to H1 is denied and you were properly admitted under F1 status on your return. You are legally maintaining F1 status until your OPT expires (+ any grace period mentioned in your I-20).

Here are your options:
1. Again apply for COS to H1 (not sure if this is possible, check with your lawyer)
2. Leave the country before F1 status expires and then re-enter on H1 visa. For getting H1 visa you don't necessarily have to go to home country, it is possible to get it done in Mexico/Canada.

My wife is working on EAD and her EAD is expiring begining of next month. New EAD has been applied. Can she work with the EAD renewal receipt if the EAD expires ? What are the possible options ? Pleas help

That's expected. The CIR contains highly controversial language there dealing with illegal aliens, which is clearly opposed by the majority of Americans. We are in the middle of it. That is it. You are entitled to renewal of your EAD as long as your GC remains pending.

Nothing! This bill passed the Senate a month before they started the CIR. Cornyn introduced the SKIL act and then he immediately withdrew it because he was hoping that it will become part of the future Immigration bill. Later on the CIR failed and we are left with nothing again.

My wife is on F1, doing her masters and is done with her course work, just left with one project (2 credits). Her college has the option of getting CPT (curriculum practical training) signed till the time her masters is not complete and then she is allowed to work off campus for 40 hours (full time).

I have also filled for my 485 application, so I was wondering what is her status now after filling for 485 . Also is it fine if she gets her CPT signed now after filing I485. I just want to be sure that getting her CPT signed has no negative impact on our I 485.

Any suggestions or anyone in similar situation

I suggest you contact your lawyer to make sure it won't be a problem.
Working on CPT is part of maintaining F1 visa status and your case is same as being on F1 visa while ones I-485 is filed.
