I had a question regarding employment in OPT STEM extension. I recently(one week back) got a job and joined as a independent contractor(adding me as a vendor to company and at the time of joining they asked me to fill W-9 form) in company. I was joined first and thought of ask them to enroll in E-verify later.

But couple of days back when I ask the HR for company to enroll in E-Verify in order to update to school officials. HR refuses to enroll because as I was working as an independent contractor and not coming under their payroll.

Regarding how do I get paid? They will pay me bi-weekly. But I need to rise the invoice and submit time sheet and give it to them so that they will pay me a payable check.

And even I got approved OPT STEM extension couple of days back which I was applied through my previous employer.

Is there a way to come out of this situation?

Even thinking of adding a consulting firm layer in between the company and me but I don't want to do that. Please help me out.

My wife H1B was approved under Consular Processing. She got job offer now and it is a Consulting job to Hire. We applied COS at CSC by Premium processing. Reached application on Sep 28 and Status is Acceptance by then.

1 ) Everything is genuine and in the client letter it is mentioned as 6 Months contract to hire. Are there any posibbilities of getting H1B approved for only 6 months from now.

2 ) Are there any chances of rejection

3) Sincle past week it is under "Acceptance" stage. I know i have to be patient.

4) Can we expect some decision from them this week as client is waiting.

5) At what time CSC updates the case. Is there any particular time they update the case online.

Yes. The moment you lose your H1-B status, she loses her H4 status.

Because you already filed I-485 before she turned 21, your daughter is protected by CSPA and she will get her GC as long as your case is approved even if she turned 30 before your AOS is approved (I sincerely hope you are approved before she turns 30 as she must remain unmarried until she gets GC).

By the way, my son is in the same boat as he turned 21 in 2008 too.

I'm creating a game in silverlight which would move the object up,down,left or right. i want it to be smooth when i move it. However when i hold the Key, it'll move, and pause for a split second and continue moving smoothly. how do i erase the pause so i can mak the object move smoothly when i hold the keyboard button.

I have the same situatation and called them numerous times. They say they will honour the actual date that is written on the receipt and not on the web site. When you call USCIS, you have to tell them that your receipt date is different than what is displayed on the web stie.

South Carolina Republican Senator Lindsey Graham has said many times in the past that the GOP needs to move back to the middle on immigration reform. If her H-4 has not expired she can file now for a change of status from H-4 to H-1, as per the last action rule, her petition filed now will override the earlier request for H-4 extension. If she does not have an unexpired H-4 she can file for COS based on the pending H-4 extension request by including the receipt.

According to the mathew ohio website. there is apparently a very hot legal battle going on between the DHS and a happless immigrant who had been arested for out of status presence. The immigrant was on an H1b and had filed an application in a timely manner and was awaiting decision on his application when the DHS official arrested him and tried to deport him. Please post more information on this issue if anybody is aware of it. His I-94 expired, however, his petition for H1b extension was pending!!!!:o:o:o
