You would require copy of the approval notice of 140 from the old company.

In the new company, you would need to file a new labor via PERM. Once it is approved, you would need to file a new 140 and use the copy of the old approved 140 to port your priority date.

I think this memo is about NATURALIZATION - so yes it's about Citizenship, not for GCs or I-485s.

I am going to complete my 6th year on H-1b, this year end. My I 140 is cleared and I am going to file for 3 years extension. In the beginning of this year, for 3 months pay stubs are not run, due to some personal reasons. Will this affect my renewal of H1. We need to submit 3 pay stubs, before applying for extension. There will be a shortfall of YTD, when compared to actual. Please share your thoughts, who have clear understanding on these. thanking you.

I'm coming to the US for the first time on H1B. Do I need a one way or a return ticket? My travel agent told me that since I have a multiple entry visa (expiring on Oct 2011) a return ticket is not required unless I need to travel back home within one year. Could someone with knowledge about this issue help me out. I would really appreciate a reply from someone who recently landed in the US on H1B.

Ticket does not matter if you are on H1B - one way should be fine.

What your company says is correct. there are stringent rules on posting. I dont see anything suspicious on your company's part here.

My H1B 6th year expires in December 07,

I applied for I140 using 2004 approved labor in July 1st week and applied for 485 this week.

In a particularly liberal construction of the law, Mr. Yates indicates that, if a labor certification, previously approved for another "green card" candidate but unused for that candidate, is now being used to support an I-140 petition for an H1B status holder, the date of filing of the original labor certification may be used for that H1B nonimmigrant to file for one-year incremental H1B extensions, as long as additional proof is submitted that the person has a pending or approved I-140 based on that labor certification. Under this interpretation, therefore, a person who is using a substituted labor certification that was filed more than 365 days prior, but whose employer filed the I-140 petition for the H1B employee only two months before the six-year H1B window expired, is now eligible for the one-year incremental extensions.

Can I get 7th year extension with help of I140 receipt?

Is any one applied for H1B 7th year extension using 21st Century DOJ Appropriations Act, if yes what type of documentation we need to submit while applying for extension?

if your LLC is sponsoring your GC petition, then it is not possible. Your EAD will have certain conditions for employment, usually in the same line of work as the Labor Cert. Unless of course if you are a dependant EAD, then there are no restrictions on your employment opportunities.

Yes he can apply for a TN again, no limit on the number of times alien can enter on TN. If he leaves while his COS is pending it will be considered to be abandonment of the petition.

My 6 years on H1b expires on Nov 2010. I have 140 approved from company A.

1.What's the earliest I can apply for 3 year H1b extension based on my 140 approval?

2. If I switch to company B right now and get company B to file for labor using my approved labor's priority date, are there any time restrictions for filing H1b extension?

3. Suppose I get a 3 yr H1b extension from company A, can i switch to different company after that using that H1b visa?

USCIS updates the status with this generic message when they receive response to the RFE. Regarding the interview, I think its random and there is no specific criteria for USCIS.
