My I-485 is pending, was filed in July, 07. My PD is June, 04 (EB2 India). I-140 is approved. I have to leave the US for a year to work on an expat assignment beginning last week of December, 07. I have my EAD and AP. Also, I am on a valid H1-B until May, 2008 but will be applying for an extension until May, 2009.

Please let me know your thoughts if it would be ok for me to leave the US for a continuous period of one year while my I-485 is pending? I plan to renter the US on H-1B and not EAD/AP.

Also, does one need to be physically present in the US to renew EAD and AP? My EAD and AP will expire in September, 07 but will I be able to renew them when I am back in Jan,09?

For the period I am gone, do I need to pay any taxes on my foreign-earned income if I am going to a jurisdiction with which India has a favorable tax treaty? If my I-485 is pending but I am not working in the US, I do not need to pay taxes for the income earned abroad if I do not meet the "substantial prsence test" (183 days)?

Any thoughts will be much appreciated.

Please help me to sort out this difficult query.

Company 'X' holds my H1 Visa and i got an offer from comapny 'Y'
So i can easily xfer my H1 to company 'Y'

But i am expecting a better offer from company 'Z' in couple of days probably 2-3 weeks.It can be also the scenerio tht they may offer me in a day or two when my H1 xfer is already in process from company 'X' to 'Y'

In that case when can i xfer my H1 to company Z?

The worst solution is to get my Visa xfer to company 'Y' and after a month or so get it xfered to 'Z'. Is that possible and allowed to xfer it so quickly?

There is nothing called "H1b transfer" basically every company applies new H1b but it is within quota and you can have multiple companies holding your h1b visa but you can work only for one company on full time rest part time and there is no need cancel H1b, just go and join the company you want to join. You can take $5k each in cash. And unlimited if it is Travellers checks.ON Travellers checks you are going to pay commission and crap. I do not personally recommend it. I do not know how it is working now adays. You can check on department of homeland or customs website to find exact amount that you can take as cash. And do not take more than what is recommended.

You can work 2 jobs as long as you have...2 H1 visas, one for each job!!
That could be 2 part-time or 1 full time and 1 part-time.
I believe there could be a problem if you have 2 full-time H1 jobs at the same time...

Politicians are used to pander to their audience.
All he did was to use some keywords - "strategic alliance"; "peace"; "fight terror"; "immigration reform" etc.
He needs to list out the specific issues that he thinks are issues; and then propose a solution that would not only fix the said issue, but also prevent it from recurring.
Broad statements don't mean anything. Everyone knows the immigration system in this country is broken. But no politician has listed out (nor acknowledged) the root causes of the broken system.

But unfortunately, being a politician, he will not say anything that would put him in a corner.

Silverlight can be deployed on networks using something more centralized like group policy. I don't believe average end users can install SL3 without admin priviliges.

I have a question regarding i-94.My i-94 is going to expire in december 2009.I have valid i-797 and visa upto 2011.when i went india last year december he gave i-94 upto dec 2009 because my passport is going to expire.now i got new passort and I just want to ask given current scenario is it easy to get i-94 renewal?

Well, if you forgot to fill the native language thing but signed the form, you don't have to worry about anything. Although the form is incomplete, the officer has no way of knowing for sure that your native alphabet is other than English... You may or may not get an RFE on this later...

My wife and I are currently working on EAD and have used the AP to entry the US. We will be going to the Canadian consulate to apply for Canadian Visa (want to go on vacation). I had the following questions:-

1) What all papers are required?
2) How long will they issue the canadian visa for? I am planning on obtaining a multiple entry visa. When I was on H1 they issued me a visa which was till the end of my H1 expiration date.

My brother is finishing his BDS in India this year. I am planning to bring him to US for the studies in USA. Could you please help me on what he needs to do to enter here and are there any hurdles. I am new to USA too so don't know much about the ways so trying to find out. All I heard is unlike engineering its difficult to come for medical studies to USA.
