You dont have to apply for a COS as long as she is leaving US before her current I-94 expires. However, note that when she goes for her H4 interview, she might be asked to prove her H1 status by showing her employment details (recent pay checks, tax documents..) in addition to your employment documents before they give her the H4 Visa...This happened with one of my friends at Chennai embassy...Just wanted to give you a heads up on that....

I am new to this forum. My husband is working for a desi consulting company and they also filed for my h1. Now my hubby is planning to move out.
When my hubby moves out they might bargain using my h1 approval.
They havent given me a copy of the H1b approval. Could some one tell me the reasons to get the I-797 copy from the consultant?Once I get it I would like to transfer to some good company.

I heard that there is a I-824 form requesting copy when the actual approval notice is lost. Can I file for that and it seems it takes 6 months to get the actual copy.

Does the info pass help here ?

No that is wrong assumption. H1B can be extended only based on the beneficiary's self I-140 not spouse's

Consult his/your attorney and renew H1B. At least start GC process to be eligible for H1 extension after 6 years

I have question to you. I am July 2007 filer. My EAD and My wife EAD expiring on 09-25-2008. I applied both renewal Yesterday(06-24-2008 -90 days before).
recently My wife moved from H1B and working on EAD ( I am still working on H1B).

1. If we wont get EAD cards in time (i.e. before 09-25-2008). What will be her status after 09-25-2008 ?

2. Can she change back to H4 or can she change back to H1?

Please advice me.

You will be able to return to same employer if you get employed again with your old employer.

Alternatively, you can file new H1 with a new employer. YOu dont need to go visa stamping, but your son need to go in either case.

Make sure you either have a project with client letter or your employer has position to employ you on genuine internal project that can be documented well. Its not question of past pay stubs for you. Its about having valid and verifiable employment now.

I am on F-1 visa since Jan 2007. and got started my OPT in August 2009. I have on campus income through out the year in 2009. so how do I file the taxes, n which forms. for tax return 2009.

also I got married to a F-1 student in Jan 2009. She is also having her OPT started in August 2009. She has income only on OPT (from Aug to Dec 2009) so which forms she should also file.

my wife did paid her college fee in Jan 2009. and we have paid the rent through checks on leased apt.
So can she/we ask for deduction of any kind?

If both of you having 1098 forms from school you can file for Hope-credit (each gets $2500 credit, thats huge amount :) ). You cannot show the Apt. on tax form.

Send him a letter by certified mail and then dump the bloodsucker ! Noncompete agreements are very dubious in the first place so I doublt the employer would try to reclaim the loss.

(2) Once your 140 is approved and 180 days have passed after filing 485; it will not affect you even if your employer withdraws the 140 application. My company filed my 7th year H1 extension and my wife's H4 petition at the same time in Dec 2006. USCIS online case status shows received and in process for both H1 and H4.

Recently, we upgraded to premium processing. However, only the H1 case status now shows as being done under premium processing. Does that mean that only my H1 will be premium processed and not H4 even though they both were filed together. Is this normal. I am hoping both H1 and H4 will be premium processed. I know that USCIS adjudicates H4 also in premium processing for such cases as a courtesy. Just wanted to know if anyone has been under similar situation before and got only their H1 approved in premium and not H4....The whole purpose of me upgrading to PP was to get H4 approved before the H1 quota begins in April as our H1/H4 were expiring this summer and my wife's employer is filing a H1 COS petition for her in PP under the 2008 H1 quota....Didn't want to take any chance of her H1 COS getting approved without a I-94 because of her current H4 expiring in summer.

When I went to my county health dept to get vaccination shots (for medical exam), they asked me to see the civil surgeon first, "else you will pay lot more for shots that you do not need". I gave them the standard list (MMR, Polio, DTaP, Influenza type B, Hepatitis B), and there are a few more in (page 3 of) I-693 form (http://www.uscis.gov/files/form/I-693.pdf). Someone on this thread (http://immigrationvoice.org/forum/showthread.php?t=5553) (second-last post) says you may need a shorter list based on your age group. Did anyone recently take these shots, and can she/he give the correct list here?

I only took TDaP (Adacel) shot. For MMR, Hepatitis B and Chicken Pox I had a blood test which showed that I am immune. You do not need polio shot.

This requirement has been waived in Nov 2007. Please search Murthy.Com or USCIS.Gov for the memo.

Extension = from the time requested = for example 4/1/2008 to...no more than 3 years. 3 years is the max time requested. So, if you company requests from 4/1/2008, it should state until 4/1/2011.

I am working with A on h1b and the visa expires on May 1st 2010.
Recently I got another offer with B and they filed my h1b transfer (regular).
The offer they gave me verbally is different from what's on the offer letter, when I contacted them there insist that they never "promised" , so I did not want to take that offer now.
Can I now ask employer A to file the extension and continue working with A?. Will that create any issues if the transfer with B gets Approved/rejected?. or is there any alternate?. Please help.
