I took my car.Once you get landed immigrant status in canada, everything needs to be transferred with you. They asked me either transfer my car or take it back to USA right away.As I have my family with me, So I argued for a while but no success. So i went to the customs and let them fill up the paper work to get the car transferred.Also they dont let your personal car to list in the things to follow paperwork, if you are driving the same car.I came back to USA after two weeks. But the transfer procedure still require you to get clearance from the USA for which you have to give the 72 hour notice to some agency and then take the car.Also you need Manufacturing clearance recall letter(which can be done both in USA & Canada).
I did not pay canadian customs a fee which is 209 + tax, as I want to bring the car back to usa. You have 45 days to get all this things done , other wise You have to export the car back to USA. They told me to send the payment or they will send a reminder notice after 10 days, which to date i have not received yet.You have to buy insurance and change the odometer into Km and also headlights should remain on when you start your car. I dont know what gonna happen, but I will sell the car if I have to, and send them the sale receipt.By the way i entered from detriot, and everything went smoothly.

We filed on July 20 to NSC. CSC acknowledged the receipt on September 19. On 9/21 we recd a notice from CSC stating that our cases are transferred to NSC. However EAD and AP applications are still being proceesed by CSC. Just recd an e-mail that EAD card production ordered.

My case was received by NSC on JUN 1st. They issued the recipt numbers on JUN 5th. I am still waiting on my wifes. They could clear on Monday.. Looks like NSC is also trying to speed up things. They are just one day slower than TSC in issuing recepts.
How did you get this information so fast? Did you call them?

Yup, kshitijnt you are right on target, we need to do some thing constructive and let our voices heard.

BECSufferer made it right heading...channel your anger.

My intention was more to think in right way and discourage potential -ve result bound strategies.

During presidential campaign there were all over promises on clearing backlogs, we can go on that basis and make a point of that.

One thing is clear if they like to stop outsourcing sure they have to encourage and stream line legal immigration they cannot stop or survive but cutting outsourcing as well leaving this legal immigration in limbo.

Besides what we can do at this juncture, keep our voices heard by contacting, writing letters.

1. In a world leading country processing a decade back applications is not an encouraging trend to legal immigration, this may send a wrong signal to legal immigration over illegal immigration.

2. Can highlight ecomonic point based on these math...
Ex: 500,000 EB backlog persons contribution to the country, social taxes = xxx, medicare = xxx, travel=xxx, housing =xxx.

I have to do the landing before june, 2008.

I have already used AP to enter US after my last trip to India. So IO at POE canada will know that I have pending 485. don't know how to handle this situation.

I am planning to do the landing in last week of may via Niagra falls. (toronto)

anyone with similar status done landing please share your experience.

I filed concurrently for I140 and AOS by sending in the application packet today. My lawyer suggested that even though the USCIS receives the packet tomorrow but are not able to receipt it before the 17th they can reject the it. I am a little confused about his advice, can anyone please provide a clue and sooth my nerves? It would be a tremendous obligation.

Your lawyer is absolutely wrong. All applications received on or before 17th Aug.2007 must be received by USCIS, even if they can't open the the packets on or before 17th Aug.2007.

8/2: Infopass Appointment @ San Jose -- IO bought the file to the counter and asked for EVL and also a letter from company stating they support my I140.
I work for Top 5 company in Silicon valley. Company attorney got the required documents in 3 days. IO also generated FInger Printing appointment the same day.
8/11: Infopass Appointment @ San Jose -- Submitted the EVL and other documents given by the company. IO made copies of our Finger Printing notice.
8/19: Infopass Appointment @ San Jose -- Officer checked the status of our case and indicated visa number has been assigned. Files are with the same officer.
8/20: Card Production ordered for my wife and myself.
{ 10 yr + 6 Months in this country ( F1 - Masters - H1 - Green Card)

going back to india is a personal decision, and each case differs. circumstances are key in this decision process. one or more members' past experience in india will not apply...

yes that is true. I did not had any problem with mortgage. Atleast as of today, it is illegal to deny mortgage based on immigration status. If you have any idea of buying a house, it is better to do it before any law changes if at all there is one in the pipeline as you(madhuri) suspect.

It is all how you see your life. Just concentrate your energies on positive stuff you have. This will bring you more energy and most importantly, it will bring more for those who sorrounds you like your family. Peace in family is very important to pursue anything in life and especially career and that too as an immigrant in US without GC.

I bought my house more than 2 years ago and refinanced 2 times. There is no problem in getting a mortgage. Make sure you tell them that you are on H1 and you should have a very good credit rating.

We are doing this to help everyone. Especially, those whose PD is still current as per September VB, if you act with in next 5-10 days, you have a chance. if you can individually file a law suit when your PD is current.Since my guess is, the lawsuit we are working on in this thread, will take some time to shape up. But this is a Biggie, we want to create a big impact. Meanwhile, folks who are out there waiting since 2001,2002.... you can follow the links that i pasted in my previous message. People have won lawsuit very similar to the one we are talking about. I can even paste some of the I-485 lawsuits filed because of unreasonable and unnecessary delays, when PD is current.

Been in the US since 1998, have an EB-2 PD of 2001, have played by the rules all along. Still no GC... And, the dates are going back to 2000 from the new year.. I've lost hopes...

I'm pretty close to getting clinical depression because of this game played by USCIS, Labor Dept, FBI and my own bad luck.

SKILL bill, OMNIBUS, etc. comes and goes. IV does seem to be doing things to lobby for the community, but let's face one reality. Like a news article said, no one in congress or senate wants to touch immigration even with a long pole until 2009.

The US has been very good to me (other than the GC part), more than my home country (India) which is why I'm still here.

Have invested too much of time in this country to just pack up and go. Just curious if any of you feel this way? How do you handle such depressing feelings?

Believe me dude when I say that GC is not the real problem of being depressed. There are other so many kinds of problems in life which have no bearing on whether you have a GC or not . I personally have some of them and I wish they were gone . They are my priority and to me GC is just a vague distant dream .. if it comes true well and good or else life goes on.

Health, family and friends come above anything and if you have all these lined up good and well they beat having a GC :)

Get busy with anything that you can find .. maybe try making some friends and you will find "its a wonderful life !"

So you are laid off so what is the big deal? You should be able to negotiate somehow or escape layoffs by doing something or the other. There are people in my company who survived 6 layoffs. Your layoff is your problem and nothing is fair in the globalization.

Actually my company went bankrupt and eventually everyone got laidoff...


I have paid taxes to this country for 9 years now and I deserve a GC.

We have had to give up our dreams stuck at the same job for 5-6 years..Did not take promotions, pay hikes with fears of screwing up the GC process...many got laid off....

The process is just screwed up..no other country follows it and it is the same process from last 20 years...
