I have an issue with my I-94 and need your advice on this.

I came back to US from India vacation on 10-Sep-2007. My H1 Papers from Company-B got approved(on 5-Sep-2007) just before I start from India . So I could not show the new Company-B h1 papers at the Port of entry to the CBP officer. I got my new I-94 date based on the old Company-A H1 papers which is valid till 30-Sep-2007.



I red on the Immigration Forums that USCIS follows last action rule to determine the validity of I-94. In that scenario, the I-94 that comes with my new H1 paper gets invalidated. If it is true, am I out of status after 30-Sep-2007?


Could you please advice on my possible options on this issue?

I have a EB2 labor that is approved from BEC. But i have already applied 140 and 485 using EB3 labor and both are pending. Now I am planning to interfile 485 once my old 140 approves.

My question is does my labor expire, If I dont use it to file 140.

yes. 180 days past its approval date if it was approved since the law banning EB substition came out (in May or June this year). If it was approved before that law came into effect, then it will expire 180 days after the law became effective (Jan 2008).
Go ahead and file the second I-140, you can have two pending.

Under current rules, a labor certification (LC) does not have an expiration date. Under the new regulation, an LC will expire after 180 days if no I-140 is filed to proceed with the case. For labor certifications approved on or after July 16, 2007, the I-140 petition must be filed within 180 days of the LC approval. For LCs that are or were approved before July 16, 2007, the I-140 petition will have to be filed within 180 days of July 16, 2007.

It is illegal to overstay on a visitors visa, for that matter it is illegal to stay on any expired visa.

I don't think it is illegal to stay beyond your I-94 expiration date, if you already file for an extention or change of status.

Generally lawyers advise not to travel, when h1 or h4 application is pending. as your H-4 approval will come with another (new) I-94 attached to it.

So best thing check with your spouse's lawyer.

I forgot to post my update - I actually did get my appointment with Xvars.com (http://www.xvars.com) . They got me the appointment about 2 days after I signed up, and I got my stamping done in Toronto on Dec 16th. I also chose Montreal as backup but got my original choice. Good luck to people stamping visas in canada. it is much easier and faster than going back to the home country.

I work with a consulting company on client side. The client is planning a shutdown for 2 days a month - 2nd and 4th friday.

Do you guys think its gonna imapct 485 application. I am asking this question cause the labor was approved for 40/hrs per week and the salary slip shows the number of hrs worked per month which will be lesser than 160 (incase the month has 4 weeks).

BTW, I am on EAD and 140 approved couple of years back.

Received the RFE today. It was asking for my birth certificate copy & translation. My lawyer says this is very common. For me this is stupid, they already got my birth certificate copy and the translation.

yep EAD is linked to your 485 application and not your employer. especially after 180 days of 485 filing a lot people consider themselves free to jump the boat with very little to no issues.
