My Labor approved in May 2007, Still i didn't received my Labor Hard Copy.

Anyone in same boat??:eek:

My wife has recently converted her H4 to F1 by applying for COS through I-539. We are yet to receive the approval notice by mail, but we have confirmed online through USCIS that its been approved.
The question is - at what date would she be deemed to be on F1, is it from the date of the F1 approval notice or is it the start date mentioned on I-20.

What is normally seen as the start date? Can some one who is on F1 respond ?

If you have a receipt as proof that an extension application was filed on your behalf before expiration of your H1 then you have 240 days starting from the day your visa expires before you should get an extension. You will be out of status if your case is not resolved in the 240 days deadline. I cannot comment on the implications of missing out on a deadline for responding to the RFE.

As far as I know, nothing that is being considered in the Senate is going to relieve the Green Card backlog.

They have plans to eliminate the backlog in 5 to 8 years not immediately. So if one chooses not to re-apply under the new point based system, waiting time doesnt change much for him. (It may be become worse because they are cutting down immigrant visas in EB category from 130k to 90k)

But if one decides to re-apply under the new point based system, things may become faster.

I am hoping that under the new system, they will give some priority to people who already waited for a significant amount of time under the old system.

This is just my analysis based on the articles I read on the internet and the bill text itself.

I will be getting married to a H1 holder in India and because of the time involved in obtaining a marriage certificate, am planning to leave shortly after the wedding with my existing B2/tourist visa. What are my options of applying for a H4 once I do that - would I have to come back to India to apply for that, or can it be done from Canada/Mexico - are there any risks pertaining to intent of travel associated with such an action. Yes, a friend of mine was not given her VISA they did not say denial instead said they needed to further confirm her qualifiactions and field of research. This is bc she works in boitech and at that point there was the anthrax scare.

I filed my EAD and AP renewal on Sept 17 (20 days) ago but still I haven't heard received neither receipt notice nor my check being cashed. Is there anything we can do to find out about the receipt notice? Fedex tracking shows the mail being already delivered. I am currently working on EAD and recently used AC21 to switch the company so EAD is very important to me.

Please provide your feedback and if anyone is having same delays in getting receipt notice for EAD / AP.

It should not take this long.

Did you send your application by Fedex or some other courier that had tracking? Are you able to track when the package(s) reached the Service Center? Which Service Center did you filed your applications at?

They call EB appointments E2, E3 etc

There are some E2 appointments in the Aug .pdf but not the September.

I think in many ways its advisable to not leave the country until you actually have the approved AP in your hand.

In this case i guess the folks got a bit lucky. The officers at the POE would have to really dig deep into your case details and compare all sorts of dates to probably determine that you left US before you got your AP.

I doubt there is anything that automatically cancels or abandons your application if you travel prior to receiving the AP approval notice.

The H1B is counted against the cap only once in 6 years. As you already had a H1 any one can file for your H1B NOW.

You need your employer's approval, without them you cannot change the attorney. If employer's says yes, then you can switch attorney.
