I personally believe none will be affected and left too behind (yes, they will be delayed a bit, they will have AP/EAD to hold on to).

(1) I am on H1b and wife on H4 . I have PD of Jan 2008. Now In july 2009 VB shows Eb2 india with PD of Mar 2008 and F2A with Jan 2005. I will be able to file for 485 will my wife can file 485 ?

(2) If she cannot file and what if my company insist me to be on EAD and resufe to extend my H1b. What will be status of my wife.. ( Assuming she didnot file AOS while I did ).

(3) What will be her category or status if I am lucky and get GC in 2 months since my date become current ?


I think just simply saying use FB quota for dependent doesnot make sense. We need to have answer to this. I agree that Law allows INS to use FB qupta for dependent but at same time so many other restriction prevent them to use it. Like dead lock condition.

But let me remind you that this seems to be the same provision that S1932 had in the past. If passed as it is, gives some relief for so many people who are waiting to file I-485. but keep in mind that AC-21 should be brought back in, to take any advantage of portability

Got a CRIS Notification for EAD Card PRODUCTION dated Sept 2nd for my wife.

EAD receipt Dat: July 23rd
Card Production date: Sept 2nd
They say it will take 30days to get in the mail..
No idea whether it really takes 30 days or less so I can verify actual validity of the EAD card !

I don't know what worked..mailed TSC a letter to expediate.. Also emailed Local Senator and Congressman to expediate my spouse's EAD renewal.

Is Lin for Lincoln, NB or something like that? Is one I-140 and the other I-485?



LIN is the prefix of the id number given to your application if you are applying to Nebraska service center, like WAC is for the california service center. it might possibly mean Lincoln,Nebraska.

I believe all 485(along with 765 and 131) applications should go to Nebraska service center after the bispecilization rule became effective. Not sure where the 140 application should go to though.

here is how you decipher the receipt number, be it from Nebraska,California,Texas,Vermont

LIN-03-123-5-0001

LIN - Service center,LIN for Nebraska,WAC for california,SRC for Texas and EAC for vermont

03 - the year 2003, it should be 07 for this year

123 - working days count from the start of the immigration year(immigration year starts in october i believe)

5 - Not sure what this number is, all i know is, it is 5 for all the 4 service centers

0001 - count of the applications received at this service center on the given day(in this case day-123). This can go from 0001 - 9999 but normally its about 2000-3000 application worst case 5000-6000 applications per day(not sure how they managed when 150,000 H1 applications came in one single day!)

INA Sec 203 talks only about the eligibility to apply the I-485. But the visa number is derived from a relationship to Principal applicant of green card. This is true for all categories Including investor, asylum, Employment categories. Please note that It is Dept of State that is responsible for this allocation not USCIS.

The relationship with the principal/primary doesn’t make derivative eligible for same visa as primary.

EB1, EB2, EB3 are also visas. with specific qualifications like H1 and L1.

H1b dependent gets h4 (different visa from primary) and not counted in h1b quota.
Same applies with L1( dependent doesnt get L1). Same applies here, the dependent/derivative is not eligible for **same** immigrant visa type/preference. While h4/L2 has no quota and is of temporary nature. The FB2A has quota and is permanent. That is the only difference.

It is the situation of the dependent/derivative that matters. So FB2A is the right category.

US Healthcare system is for Profit, some medical facilities in US are exception, but if you see the overall Healthcare system it sucks and its all driven by insurance and big Pharmaceutical companies.

Thank you all for your help and support but I have made peace with my fate. I have pancreas cancer with VERY poor pragnosis and trust me I took 5 different opinions with the some of the best hospitals in US and Europe.

Regarding my family, something is working out in Sweden and probably all of us will move there permanently in 1-2 months. We have some relatives living there.
