If I'm not mistaken, PD is only linked to your I-140 receipt notice as it is specifically for labor authorization / certification.

As long as it shows on your I-140, you should be fine.

After a long journey on several non immigrant visa's my GC finally got approved. The questions that I would like to throw out for the group to think on is regarding the period for which one has to keep all the H1/H4 approval notices and supporting documents?

In my case, I have been here for 10 years and have a 15 pound folder that has all the approval notices (I-797) and supporting documents (copies of I-129, transcripts, everything under the sun)

I would hate to have to carry this for the rest of my life.

you will need to keep them until you are naturalized. scan them and keep digital copies in a handy location, while you store these originals somewhere in the basement.

a court actually agreed with USCIS....so a person can work but can't be present in the US and USCIS won the case.

It makes no difference whether you file premium or regular H1. It goes thru same amount of scrutiny. Only difference is that you get it in 15 days with extra $1000 instead of 3 months it normally takes today.

Today, My H1B transfer got denied and waiting for denial notice. Employer is planning to appeal on denial case. (I am assuming that "Denial could be becasue of client letter was not furnished)

My Layer: Employer->Company A-> Primary Vendor -> Client

My I-94 is valid Nov-09-2009 based on previous employer petition. Previous employer notified USCIS on H1B termination.

On this, What would be best option.

1. File a new H1B case thru current employer (while is waiting for appeal result, as a back up plan)?

2. can I continue work for current employer since my I-94 is valid till 11/09/2009 and filling MTR?

3. Apply for H1B transfer thru primary vendor's sister concern?

wanted to see the timeline of EAD renewals currently..I have a EAD renewal receipt notice date of June 18th......was wondering how many days is TX taking to approve the notice....

Did aanyone around June 15 -June 20th get any approval yet?

My wife's EAD renewal receipt notice date is June 19th - close to yours. Also at TX.
Lets keep each other informed on any developments.
As per USCIS website, the processing time at TX service center is 3 months for EAD.
I hope its sooner!

The DREAM Act died in the Senate in December due to a Republican filibuster.

I am on H1B. my wife is on H4. I want to apply ITIN no for my wife.

Q1. should i file under "Spouse of U.S. citizen/resident alien" or "Dependent/spouse of a nonresident alien holding a U.S. visa".

Q2. what are the documents I need to submit with the W-7 form.

Q3. is ITIN application only possible during tax return filing or I can apply and get the ITIN number early and then use it during my tax filing.

Q4. How much is the fee for the ITIN no.

H1, H4 (spouse) and H4 (kid) living happily.

File 485 and gets EAD/AP.

H1 doesn't use EAD.

H4 uses EAD and hence looses H4 status.

I-485 is denied.

Now, my understanding is that spouse has to go out of country and come back again on H4.

What about the kid?

When does the kid loose his/her H4 status? (When both mother and father use EAD)?

This is just my thought, I would believe when the father (or whoever was on H1) uses EAD, the subsequent H4's would get canceled and their status would be Pending AOS. If 485 is denied, and if H1 person has not used EAD, then both son and mother can re enter on H4.

I would suggest you ask your employer B to file thru premium processing. Just to be on the safe side

cancellation takes atleast a month if not more. (4-5 months is not a confirmed number so its better to assume the worse case of 1 month)

most probably by Oct with new year dates it move to May 2001 but later bove back to old priority dates once approvals come from BEC's
