That may be a RFE and then eventually you have to give that letter and do more bargaining with your employer...

You wont neccesarily get RFE for omitting the employer's letter. Your 485 CAN GET DENIED.

YOU NEED EMPLOYER'S LETTER THAT STATES THE INTENTION OF HIRING WHEN GC IS APPROVED. Otherwise, as per USCIS memo recently issued, the officer can simply deny the 485 without bothering the send you an RFE to explain the missing document.

The recent memo says that if the "INTIAL EVIDENCE" is missing, then the petition can be denied outrightly without having to send the RFE.

Also, read the filing instructions on form I 485. The employer's letter is listed under "Initial evidence" list.

If we just keep watching the visa bulletin every month, there would be no change. We will see November 2001 in next couple of months after that it will become "U" again. We got to do something and we need guidance and direction from IV.

My son is 20 months old right now. I don't think he would have the slightest idea of how US is :) . He is going to enjoy the same education system which churned me out :)

When I went last time, I checked out the schools. They are not bad as I thought. All are improving. Since my son is a US citizen, he can easily come to US for college education.

The relief for EB3 comes because a lot of EB2's/EB1's will be gone from the quota. So, if the queue is smaller, you get it faster. The way I look at it, we want the queue to be smaller.

how to use the spillover is purely an USCIS decision. Only to use the spillover to avoid wastage is a law, which is already in place. Infact USCIS was not doing this top down approach on spill over few years ago, this is a new practice they are following since last Fiscal Year, so I strongly believe if Congressmen/women puts pressure/more request it can be changed to a fair application of visa spillover to benefit all that are in the queue for a long wait.

The Spill over changed from the Year 2007 ...It will be Fair to allocate the spill over Visa to oldest PD for the Retrogessed country.

Senators and congressman in MN are not very helpful I guess, first they told me wait one month and if I dont hear anything then they will send a request, after one month I called them up to find out whether they can help, that guy in senator office told me to wait 6 more months.

It's not like my case is lost or in transit or not assigned to an officer, it is assigned to an officer on june 29th, officer at infopass said may be the officer who has my file have more old cases compare to others.

Personally, I think I'm beginning to see the shift in attitudes of young Indians now visiting the U.S. - of course, many will be tempted to stay in due course, and most of us here do truly appreciate what this country has to offer.

The point I'm trying to make is the comparative state of the nations (both India and the United States), their respective economies, consumer confidence and hopes of their people, is in fact changing mindsets.

There's no denying that this major shift is well on its way. It's no co-incidence that every single Indian I talked to in the last 2 weeks (temporarily here for education/work/whatever... ) immediately ruled out the idea of making the U.S. their home long-term, or even in the medium/short-term.

In stark contrast, though, the H1B visas do get used up within hours of the visa lottery being opened... but I wouldn't assume all of those wanting to work here for some time on a H1B visa will want to stay back.

Again, I don't have statistics to back up the theory - just anecdotal evidence, with a sampling far too small and based on my own personal experience and conversations...

Give them a year or two more, when they have become comfortable with the american lifestyle and facilities we now take for granted (driving on freeways, easy access to libraries, parks to go for a run etc), and they will be probably singing a different tune.

I came here eight yers ago muttering the same "Will make a few bucks and go back home" line. Still here and living it up :)

I took up running 6 years ago primarily as i was trying to quit smoking, and also, there was a great running track right outside my house (obviously, free for anyone to use). Then I went to Mumbai last year and decided to go for a run, five minutes into the run and i was being chased by 2 dogs (and i don't mean the cops :p). The point i am trying to make here is. There are things in this country that we start taking for granted. lets appreciate it!

Another tip i would suggest to keep your mind occupied is to learn a foreign language. Invest in an Ipod if you do not have one already. Download free podcasts thet teach french,spanish, german etc. Listen to it while running. You are doing two things at the same time, staying fit and learning.

maybe we can have an IV 5K run sometime in the spring if things do not change. just a suggestion..

My applications ( I-140; I-485; I-765) were mailed on July 27th to NSC and they had acknowledged received on JULY-30th as per the mail delivery confirmation.

Today I recieved a note from my lawyer that the receipt notice has been issued for all of my applications.

Phew that was a relief as I was about to leave to India soon and was worried about travelling without the receipt number.

For variety of reasons, I wish to explore option of consulting instead of permanent corporate job. Can I do consulting in my own name directly or do I need to be associated with some company?
Green card (EB-2, Nov 29,2004 PD) application is in my name. I have filed 485 this July and expecting my EAD any time. I will be invoking AC21 after 6 months.
But need answer to this question
A. Consult on own?
B. Go through a consulting company?

I prefer option A.

What is your 485 notice date and which state are you residing?

IV effort needs 50 thousand dollars to make sure we can meet our immediate needs and also make a big impact via this advocacy day event. There are several large and small expenses like booking hotel conference room near Capitol hill for organizing the event/situation room, Organizing reception for lawmakers, their staffers, and administration officials to attend, creating advocacy packets for each appointment taken, advocacy firm fees for helping out with a large event like this etc. We can plan more ideas like Press briefing event, full page ads in national newspapers if we can have sufficient resources. This event will most certainly bring our issues to the national center stage and help us get much needed immigration relief in the months ahead. Don't make stupid statements like this. It goes to show your intelligence and that you are an instigator. With statements like that you will alienate EB3 more. BTW, I contributed to DC advocacy and many other EB3s also did the same. That money apparently seemed to have have helped EB2 and not EB3.

Regarding you comment on action, many IV leaders are EB3.

It's more of a motivation to get up and do something. How much was collected? I know many ppl contributed but the contribution was very less...so u shut up ur hole or whatever language u prefer to use at ur home. My point was to do rather than posting. If u didn't get that, sorry.
