I think your employer should cooperate with you by not withdrawing your I-140.


Are you sure that if the employer is not revoking 140, (but they will cancel h1b ) i can join some other employer after receiving EAD but 485 < 180 days

Washington, D.C. � Rep. Zoe Lofgren (D-San Jose) today introduced a bill to void the recent increases in immigration fees by U.S. Citizenship and Immigration Services (USCIS). The bill would void the new fee structure set to take effect today and reinstate the previous fee structure. The bill also states that USCIS has consistently failed to reduce application backlogs and has suffered from a lack of transparency and effective management.

�Our immigration services need to move into the 21st century,� stated Rep. Zoe Lofgren. �But, USCIS has consistently failed to explain or justify the amounts and distributions of this new fee increase. While I agree that USCIS needs to modernize its existing infrastructure and procedures, they must do so in a transparent and open manner. After repeated requests over several months, USCIS has yet to provide Congress with a detailed plan for its infrastructure modernization efforts. Our immigration system should be both effective and fair; sacrificing one to achieve the other should not be an option.�

Duraikumar was probably just one of the thousands of people who posted on the blog. They cherry picked a few to highlight different aspects of the issue. Bottom line, like you said, just a lot of noise and no real action. Hallmark of this administration. :mad:

Generally an I-485 applicant can stay abroad till the Advanced Parole remains valid. In your case the best bet is to change the pending I-485 case to consular processing.

there is a little logic involved here. what if you changed the jobs between your AC21 and latest NOID. I think CIS just wants to make sure you are still hired by issuing a NOID even though they looked into AC21.

BTW I had the same situation and I had to respond to NOID with the same emp letter.

i am a pharmacist recently licensed in florida and i found 2003 approved labor but my lawyer is telling me that in order to substitute it for me i must be licensed in florida at the time of filling date of this approved labor which is in 2003.

My EB2 perm labor was approved recently and thinking of filing I 140.
Trying to port my EB3 PD, 09/23/2003 to EB2.

I missed filing I 1485 for my wife in july 2007.

My question is if I go ahead and file I 140 premium for me , lets say it gets approved soon ,my dates will be current.Should I file I 485 for my wife then ?

What happens if they approve my I 485 before I file my wife's 485.

How long it took for you to get the labor aproved?. What are steps and duration it took?

My 9th year H1 expires this month and I am planning to use EAD to continue in my job (not extending my H1B). Can you please tell:

1) What do I need to do to with respect to Employer and USCIS to move to EAD status from H1B?

let your HR know you are switching and they will have you fill in a new form for their files

2) I read in some forum posts: there is a new law OR amendment - people working on EAD with adjustment of status will be deported.. we need to continue maintaining H1B status..is it legitimate?

3) My current Advance Parole is valid till Oct'09. As I move to EAD, is AP renewal required for any other reason other than travel purpose?

EAD and AP are 2 separate things and neither affect each other. They are both based on a pending 485 application and that's about all that is common with those 2 filings.
