I got my receipt number for H1b application and its been more than a week but i still cannot check my status online on USCIS website.

It says case is not found ,even tried calling customer service .

Does it take time to get uploaded online ?
Did anyone else face this problem

I am not getting any information from my employer.
Is there any other way we can find out if USCIS accepted my application.

The consumers are experiencing frustration with the incorrect information or outdated information when they check their case status. Apparently, the USCIS has been working on it to fix the problem. Also, there were atleast 2 threads discussing PP renewals..You can do a search for those threads for renewal timelines...I think it takes them 2-3 weeks in NY Consulate to mail the new passport....You can go for tatkal service and get it issued the same day if you pay $90 extra....

I have filed my I485 on July2nd 2007 at NSC , my priority date is June2004 EB3 category.I recently saw 3 LUD's within 1 week timeframe. Is this a good thing or bad thing?? did this happen to anyone?

company simply refused my request and said to not possible.
In another company required this letter.
Also Company using illegal pirated software to make product ..

Here is little background on the same (Technical Error)

I was on L1A from Sep 2003 to Sep 2005
First H1B from Oct 2005 to Sep 2008
In August 2008, I got Second H1 extension till Sep 2011 instead of Sep 2009.

My Labor got approved in this year in March also I got my Visa approved and I-94 Issued till Sep 2011.

My First Question remains the same - Am I elligible for Premium I-140 Processing. After I-140 Processing, should i apply for H1 extension again.

Taxes are paid on earned money only. Not loans.

If your spouse takes a student loan in USA, there are other advantages though. He/she can claim student loan deduction on the taxes !! Not sure your Indian bank would provide the necessary forms to you or if they have a legal obligation to submit anything to IRS here.

I am on F1 visa. I enrolled in one of the university. I don't attend university in person. I do attend classes online from another state. My question is that I am resident of which state ?? Will I be automatically resident of state where exactly my university is ? I know it is mandatory to attend classes in person on F1. Can you please advise ? How is residency considered ?

I checked with attorney and I believe that is true, PP for H1b is not carried over on RFE reply. Response to RFE will go in a regular queue for evaluation. But, I hope this is not the case.

Yes, I read in forums RFE's and 221g both have become more regular these days.

If you apply in PP, you will receive an approval, denial, NOID or RFE with in 15 days. 15 day clock will start ticking once USCIS receives the response to RFE. AFAIK, this holds true as of writing.

I am in a situation and hope someone here would be able to provide me with some advice. I was employed by Company A since 2006 and I was working at a Client location for the last 3 years. There is company B who is the primary vendor for the Client. Recently my H1 extension was denied and so I went out of status. I reached out to my end client for help. Since they are happy with my work, they said that they can talk to another vendor (company C) to sponsor a new H1 for me. Company C is now ready to file my H1 but the problem is that Company A somehow got to know about this and is enforcing a non compete agreement on me.

I wanted to know if they can do this even though the H1 was denied and they are unable to provide me with any job. Can they stop me from earning my livelihood. I did not go out and breached any contract, I am trying to move only because my H1 with company A has been denied. The only thing is that the end client is the same.

Most of the time its scaring tactics. Anyway you dont have much option here. Go ahead and secure your status first. Then hire an attorney and face Company A legally whatever comes...

Is there a fee for filing a renew advance parole document for a application based on a I-485 filed after July 2007.

I know that there is no fee for I-765 renewal, but , there is a conflict for I-131 based on the following info:

If you filed Form I-485, Application to Register Permanent Residence or Adjust Status under the fee structure in place on or after July 30, 2007, then no fee is required to also file a request for a travel document on Form I-131 for an advance parole or refugee travel document. Those applications may not be electronically filed and must be submitted to USCIS via regular mail or courier service.

The USCIS revisited a response they gave in the April National Stakeholder Meeting Q & A <http://www.uscis.gov/files/nativedocuments/CBO_042908.pdf> to question #7 regarding fee waivers on the I-485 application package. Their initial response indicated that a fee waiver may be applied to the I-131 (Application for Travel Document) if the I-485, I-765, and I-131 were filed concurrently after July 30, 2007 and the fee waiver application was granted on the I-485.

Upon review of the applicable law they now note that the I-131 is not actually eligible for a fee waiver at any time. The legal basis for this reasoning can be found in controlling language at 8 CFR 103.7(b) provides that "... no additional fee will be charged for a request for travel document (advance parole) or employment authorization filed by an applicant who has paid the Form I-485 application fee..."

I came US on h4 visa .One employer had filed for my h1b last year,and they said i got the approval.but the employer had no job for me as part of recession.So I am still on h4 .Will I loose my H1 approval.How long is the validity of h1b approval ?:confused:

You need to be careful here. If the H-1B was approved as a change of status (COS) last year, you may have automatically changed to H-1B status on the start date. If you did not work for the employer, you then violated H-1B status.

If the H-1B was not approved as a COS, you have stayed in H-4 status. The H-1B approval could be used to get a H-1B visa, however you would need a letter from the H-1B employer confirming that there was still a job for you. The consulate would probably need this since it has been a year since the H-1B was approved. Otherwise, the H-1B is valid until the expiration date, unless the employer revokes it with CIS.

I mean should it be only Software engr in the exp letter rather than Sr Software engr, since the labor says Software engr ?
