both of us are physicians working on h1b visas .we have ead's.i want to do a fellowship.i believe i cannot do a fellowship using my ead.can i use my wife's ead,showing myself as a dependant?all help from the gurus will be greatly appreciated.thanks.

EAD is employment authorization document. Your analogy is like -

"Can I use her driving licence to drive around town". I am not sure if that is what you meant.

If you want her to be the primary applicant in your GC application and then use EAD as a dependent, that is possible. You will lose your H1B status then.

It may be better to call the USCIS 800 number and I think there is an option for change of address.

Microsoft is definitely working on increasing H1-B and EB GC quotas. It is possible that they might have been one of main proponents of the immigration clauses in S.1932

Well it looks like DOS is saying that court has no authority to ask DOS to do anything.

I know its not required to have SSN for starting the job from 10/01/2007. I am eager to know if we can apply for SSN before this date or do we need to wait until Oct 1st. Thanks

we applied for ap in octoer and the receipt date is oct 24.we have approved H1 .can we go to mexico and have stamping before the ap approves.please suggest me.

The minimum requirements for a particular job may, and often do differ from the minimum requirements for EB-2 classification. As long as the actual requirement for a given positon is at least a Master's Degre or equivalent (defined as a Bachelor's Degree plus at least five (5) years of progressively responsible relevant experience), then the position qualifies for EB-2 classification.

The labor certification and I-40 Immigrant Visa Petition will not be approved unless the beneficiary is able to document education and experience meeting or exceding the actual minimum requirements for the job as set forth on the application for Labor Certification.

Is it July 10th OR 20th - I am assuming July 10th :)

Note: We are aware that retrogression is a problem that affects people from all nationalities, however, due to the vast number of visa holders of Indian origin, the idea to take part in this event was proposed by a few members in our group. After the appeal sent by my employer, my PERM case shows status as "in-process". Does it mean it will fall under usual processing times ? Can I expect a response in the coming months ? Please let me know . I would appreciate if anyone can give some info on this.

My wife is a Canadian citizen, what is the process of getting a H4 for her? (I am on an H1-140 approved).

1)Do I file an app with USCIS?
2)Can she go apply at the US consulate in Canada?

What type of documents, forms are involved ?

The reason for this post is I was given conflicting info by my old lawyer.

Your wife should take an appointment at the closest US Consulate. She and you should then look up the list of documents needed on the website of that US Consulate.

thats how I did it for my wife but she was from India.

My I140 is approved and my I485/EAD/AP was applied last month and nothing is approved yet.

The company finances are not looking good , if I lose the job then what would happen to my GC application. I am hoping to get EAD before company pulls the wire on me though.

What would be my best options. Please reply ASAP

Dude, this is ablip, for al lwe know. So many jobs have been lost, that there are not many more to lose. Companies aer already running on skeleton crews.
Its like some person wanting to lose weight, first loses all his body fat, then not satified with it starts starving himself and starts to lose muscle mass, after that is gone, the only choice is to start cutting body parts off, to lose more weight.....

These numbers have to improve consistently for a few months, even a year for any stable, long to meadium term gains...

After waiting for a year for my FP notices and 4 SRs later I guess I took the infopass and went to the local office. The guy out there was quite nice and helpful and gave me the appointment for next day at the local ASC promptly.
Went to the local ASC and was was done in half hour. No issues.....it was a breeze...shd have done it sooner....
And here is the best part: My application had an LUD just 3 hours later.....
