Is there a way I can apply for a green card during residency for a future job two years down the road?

Hi. I realized that I made a mistake when filling out the I 485 Part Three:
Processing Information. Specifically, I filled in the I-94 number issued for my H1B as the "Nonimmigration Visa Number", instead of the visa number I got when I was still in F1 Student status.


I called USCIS twice and they informed me that I can make corrections after I get the receipt--I can send in a corrected form, along with a letter explaining the correction, and also a copy of the receipt.

I was wondering whether anyone here had done that before.

I am kicking myself for misunderstanding the form! Please help!

This looks like the hallmark of a gang initiation ritual. The teens were probably asked to carry out an act of this nature before the gang would consider them to be tough enough. So they drive around, pick a random person, and beat him up, and the hapless victim ends up dead. Sad and bizarre.

IMO: 7th Year extn can be filed if PERM is pending for more than 365 days or if I-140 is approved.

I am posting this on behalf of my friend who is on H1 (6th year expiring in Dec, 2011). His labor is yet to be filed and in this connection we have a question. Process has been initiated by employer and tentatively labor will be filed in June, 2011. Hoping that he will be done with labor or I-140 by November would he be eligible for 7th year H1 extension?

In that piece, Vivek discusses how the world has changed and how companies now need to be near growth markets.

This pieces and other recent pieces show that plodding ideas about commissions and study groups to recommend visa numbers are relics of a past age. The question is, will Congress act quickly enough on immigration reform to actually make a difference in helping our economy recover. Every immigration lawyer knows these simple truths--lazy people do not walk across the desert. And, its corollary--the Hope that is American attracts those willing to work hard to succeed. Well, the former principle is still true, at least for now. The latter is giving way to hopelessness--backlogged visa numbers ("encased in amber"), and a growing and vibrant economy in China and India. The failure to act quickly is going to cost America in the long run. Its only for people who are on some kind of visa. You don't qualify for MAVNI if you have a GreenCard and looking for quick Citizenship.

I guess we can use this thread to collect experiences from individuals who have already applied.

I went back and forth with the school for 2 months and finally got the aid. Note : school aid authorities have no clue what EAD or 485 means. You have to show all the papers and prove that you are eligible. Are you technically a parolee as well ? If yes , then you are eligible.

I agree the right way for Company B was to apply for concurrent H1-B that will allow you to work part time for Company B while working full time with Company A.

Please verify that this is indeed the case with Company B's petition.

Anybody who had an I94 issued only till the validity of the visa and not until the I-797? At the POE the guy simply wouldn't understand when I tried to explain to him that I have an extension (797) valid from 4/10 t0 4/11. He gave me an I94 only until 4/10. I read that people go for deffered inspection and get it corrected. Anybody who did that in a similar situation active in IV now? Any suggestions on how to proceed? do you go to the nearest international airport or an off-airport location?

Its common for IOs at POE to do this. Their side of the explanation is that they cannot give you an I-94 based on a I-797 which will be valid in the future. They have to go with a currently valid document. Like others suggested, you will have to either re-enter US immediately after the current I-94 expires or go to the nearest intl airport and get this done by defferred inspection.

Hi everyone!
On May 29, 2009, I filed a Form I-485 to get my wife's (from Japan) green-card. On August 11, 2009 it was denied because I had "failed to submit all tax documentation". On August 25, 2009 I filed a Form I-290B which is a motion to reopen and reconsider my case. I included all the additional tax information which they asked for so that I my I-485 would be complete. Finally, today March 6, 2010 I received a notice in the mail saying that my I-290B Form was denied simply because accidentally signed one area of the form where my wife should have signed. What am I supposed to do from here? I had a lot of people recommend that I contact my Commissioner... does he have any power to help me with that? Any help would be appreciated!!

Hi Experts,
On July 8th I filed my EAD. I never got any Finger Print Appointment from USCIS. I have been constantly trying to reach them about my FP appointment. But, on Sep 20TH I got a notice saying my petition has been denied because I have not appeared for my FP on Aug 3rd.

They asked me to file a motion, my confusion is should I file a motion or should I reapply. Which one makes it easy and fast to get my EAD ASAP.

Please help me to sort out this difficult query.

Company 'X' holds my H1 Visa and i got an offer from comapny 'Y'
So i can easily xfer my H1 to company 'Y'

But i am expecting a better offer from company 'Z' in couple of days probably 2-3 weeks.It can be also the scenerio tht they may offer me in a day or two when my H1 xfer is already in process from company 'X' to 'Y'

In that case when can i xfer my H1 to company Z?

The worst solution is to get my Visa xfer to company 'Y' and after a month or so get it xfered to 'Z'. Is that possible and allowed to xfer it so quickly?

If your AGI is less than 65,000 then you can claim deductions for US taxes if loan is taken from US bank but Good thing about taking loan from Indian banks is that-loan won't show up on US credit report.
There is no other advantage from Indian bank.
