It is really frustrating when people filing their labor from Chicago are getting approvals in not more than a month people from Atlanta are waiting for 3-4-5 months and even longer. What is wrong?

I do not know if I am doing something against the rules of this forum, please excuse if I am. I am just a father trying to do something to protect his daughter; but I know that there are many other children who are or were under similar circunstances. I am not a lawyer. My wife, my daughter and I went to talk to our Representative Moran and our Senator Webb, but they are interested in numbers, cases, especially Virginia residents; but I think that this is something national. We (my family, I and anyone who wants to join us) can go to the office of the Leader of the Senate Majority or the House or to the office of any other committe leader and give them a letter showing numbers and cases, real families that are suffering and requiring them to do something about it. If you agree, I would suggest to prepare a small database with all the cases that we know, then prepare a letter and send it to the Congress leaders.
I think that we would need the following information:
1. Your Contact Information: (Email at least; First, Last Name and Phone Number ideally)
2. State Where You Live
3. Your Employment-Based Category (EB1, EB2, EB3, Other Worker, EB4, EB5)
4. Your Country of Origin (CHINA-mainland born, INDIA, MEXICO, PHILIPPINES or OTHER)
5. Your Child's Date of Birth
6. Your Case Priority Date
7. Date Visa was available
8. Date DOL approved your Labor Certification
9. Date I-140 was sent
10. Date I-140 was approved
11. Anything Else You may Want to Add: (like current status of your case)

Hellogoodbye - Would It KillWill the completion of the Backlogs Centers help a LC recently submitted? Will my status change if an audit is required? I am just worried for the "30 days" deadline to response to the audit letter. Just in case the letter has been sent to my employer and is still hasn't been open it. :( Am I asking too much if my LC was submitted on 08/06/07?

This Saturday (10/06/07), I'll be reaching my 60 days "In Process" Status since 08/06/07 which will take me out of the first group of "efficiency" (< 60 days of waiting period) 66% at the Chicago Processing Center; now I am heading down to the second group (> 61 - 120 days) which manage 21% of the cases. Hopefully, I'll get out soon.... this is causing me so much stress....

We dont really have a month. The work on the bill is happening even now behind the scene. We wish to put in more resources and plan for more resources in the coming months. We are still getting a lot of bounced messages. people have given us email ids like abcd@abcd.com. Well, to such people we say that they will not be hearing any announcements from IV when we send a newsletter with announcements. And sometimes sensitive information will be given by phone or to contributing members only. So all must update their profile with full information and signup for recurring contributions. We may not make sensitive updates public on the forum. This will be an incentive for people to sign up for monthly contributions.

Frankly, the chances of getting an EB-2 I-140 approved with your educational background are very bleak to say the least. However, there are always exceptions and I hope you get lucky. Good luck, atleast your employer tried.
I agree the qualifications don't seem strong but shouldn't that have been caught at the labor stage?? or is it at the 140 that they check the educational background??

LOS ANGELES (Reuters) - U.S. Catholic bishops on Wednesday urged the U.S. Congress to resolve differences on immigration reform and seize a "historic moment" to give all of the estimated 12 million illegal immigrants a path to citizenship.
Meeting in Los Angeles for their bi-annual conference, the bishops said an enforcement-only approach to immigration had failed and that stronger border fences and a piecemeal approach would do nothing to deter those seeking to find work in the United States.
"Over the past 12 years, our government has spent $25 billion on enforcement of our border. During the same period, the number of undocumented in the nation has nearly doubled," said Bishop Gerald Barnes of San Bernardino, who heads the U.S. Catholic Bishops committee on immigration.
"We urge congressional leaders and the President to seize this historic moment and enact a just and humane immigration measure," Barnes told a news conference.
"Either fix it, or five years from now there will be 20 million illegal immigrants here," said Los Angeles Cardinal Roger Mahony, whose vow to disobey any laws that would criminalize illegal immigrants and those who help them has made him a leading voice in the national debate.
Lawmakers are struggling to reconcile a bill in the House of Representatives that focuses strictly on border enforcement with a Senate bill that would also create a temporary work program denounced by many conservatives as equivalent to an amnesty for illegal immigrants.
The bishops said all undocumented workers currently in the United States should be given a "viable and workable earned path to citizenship," not just those who have been here longest.
They also backed a temporary worker program and reforms that would reduce family immigration backlogs. Continued...

Am July 2 Filer with notice date September 5th on reciept and Sep 4th Online
Started in EB3 August 24th 2004
Changed job and Filed in EB2 on August 24th 2006 (month and date coincidence :cool:)
Got my EB2 I140 approval first and then I got my BEC labor approved (EB3) so filed for EB3 I140
Got approved before I filed for I485
My attorney filed our I485 on July 2nd 2007 with a letter to port my EB3 date to EB2
Wrote letters again in 2008 to do the same (I was not lucky then)
Went through Congressman (Sep 2008) and got a reply that our applications are pending normal processing time and at the time of adjudications, the officer will make a determination on the issue of the two priority dates
Had a soft LUD in October 2008 for both of us on I485
Also got my EB2 I140 Hard LUD on 7/13/2008 but nothing changed just the date and also got an email with the same message.
Attorney sent an email through AILA to texas that our dates are current last month
She also sent a letter which reached USCIS on Sep 1st
She opened a SR on Sep 2nd
And today WE got it.

more...Hellogoodbye - Would It KillComing to point, in my previous blog �Peace of mind � Do you have?� the whole purpose of writing that story detailing every minute & every hour is I want people to come out of comfort zone & see the reality. There are lot of people who live in comfort zone & when I say comfort zone all they care is they have a job, paying bills on time, enjoying weekends with family, vacation etc. I want them to come out of this comfort zone & see the reality out there & that is the reason I tried my best to put out my story in detail so I want people to imagine in my shoes for 1 min & think of what they would be doing if they have to face this situation tomorrow so they can better prioritize & plan accordingly. I have written this �Peace of mind topic� keeping in mind for both who bought houses & also those who did not buy house because not having a house will not put anyone in comfortable position when a job is lost.
I was under assumption after I finished & posted my article that people will take my experience & take a quick look at their priorities & be prepared but instead I have seen some comments like �bullshitting, Bollywood Melodrama, Cribbing, loan defaulter�s, fools, pretent to be shell shocked, overly optimistic etc but I failed to understand that how these comments are going help others ( I know your intentions were good ) instead my whole point of writing has become useless because some wants to target only the original poster & neglecting the actual content. To clarify few things let me explain on some serious concerns raised by others on why I bought a house in first place & as I said in this article this belongs to people who bought houses by mid 2008 & before. My simple answer would be �good quality of life� & I know that this wont suffice you & it might lead to another negative debate. So let me explain in detail.
I have been in this country Since 2000 & I have seen & survived previous recession so I know what it�s like. I was also present in NY city when 9/11 happened & I have to go through what every asian looking went through those tough period & believe me it was not easy. I also survived NY Blackout spending the whole night at port autority. The reason I am saying all this I am not a new comer to this country & I have seen both good times & worst so I know deep inside that whatever decisions I take I am not just taking for sake of it & neither did I buy house as soon as I came so I can gain equity. Now after all this 8 years & moving two Jobs & shifted to California in 2005 on a full time job my priority date is still now 2007 EB3 after so many years. When I shifted to California in 2005 on fulltime job I would have bought a house but I didn�t because of several reasons like many of you 1) i was not able to afford 2) My wife moved to H4(worked on H1 in NY) at that time. It is only after my wife got EAD in july fiasco & after she got a Job we started looking for house in beginning of 2008. My H1 was approved & stamped on January 2008 & I know for sure that I will be in this country for next years & we also have a EAD . Now that we have Dual Income & market has come down slow low & no one can predict when it will reach bottom we started looking for bargain foreclosures houses.
The only reason we want to buy a affordable house is to give a good quality of Life, stability & good neighbourhood for my daughter ( actually born in September ). So here you have two options either you choose to be in rented place & pay almost same amount in good neighborhoods for what you pay in mortage or you start looking for a house for affordable house & mortgage in good neighbourhood. I chose the later as the only downside is I have to pay that 10-15% downpayment & I was willing to take the risk as I knew I am here for sometime. Now for the current 30 yr fixed mortage payment is only 300$ more than what I used to pay for rent. Little did anyone know during early January that major financial companies will file for bankruptcy. It is only in late 2008 when Lehman failed & the actual crash started to happen & market collapsed which lead into recession.
So imagine even if I did not buy a house & had that down payment with me, the fact that loosing a job will not put me into comfortable position even if I had a GC. The least it would help is pay bills for few months without a job & I am sure all those people who did not buy houses didn�t plan to live on their savings until market gets back. I also mentioned in previous article �is it easy to leave everything behind? Yes if you want & No if you want to fight� & I said No, I want to fight. I mentioned that I did have some reserves & I have many backup plans even incase of worst scenario. I was merely pointing out that it was one of my worry but I did not mention anywhere that I am bankrupt. Also since my wife was on EAD now we were confident that atleast one of us will find Job sooner than later
So the notion that people who bought houses without a GC are dumb, fools, morons & all other filthy language against these people should change. As every individual is different & everyone has their own priorities & life style they chose to Live. Also people who came here ( highly skilled ) know what they are doing & some take calculate risks & some chose to lead simple life. No one should dictate others life on how they should live their life. Again I read somewhere interesting that there is very thin line between stupidity & guts & ultimately it is the person who take decisions will have to face the consequences (good or bad). So guys� buying a house is not choosing happiness for material things, at least not for me. You need not associate all the people who bought a house are trying to live American dream at whatever cost.
So guys/gals I sincerely believe that you did nothing wrong & should not be ashamed if you have bought a house because that is the quality of life you chose to live. The worst anything could happen is you will sell all this & go back to your country but not empty handed. You will go back with your assets ( lovely wife, children & skills you gained ) & these assets will help you shine wherever you are. You can also proudly tell your children & grand children that you never had to live pathetic life in America & you have always lived American dream in America.
I will end this by telling a very short story.
Back in 2002 one of my colleagues daughter who was 10 yrs at that time immigrated to USA. After living for few days one day she asked her mother �Mama have we become poor� The reason the girl was asking was back in home country in their village they used to live in big bungalow with 4 bedrooms, big backyard, two cars, so many friends, maids etc� but when she came here she was living in Single bedroom, No backyard, No Car at that time & no friends sadly. The answer to her daughter question can be given in two ways, 1) no baby we are richer than before as we now have more bank balance or 2) give her a good quality life style which you can afford & that means nice community, friends, decent house etc what ever makes you & your family happy. ( it is also possible in rented community ) but again that�s what I meant by choosing their own lifestyle.
Finally I did not buy a house because of material benefit, ego, equity etc. Home Owners should be ashamed if they don�t have proper justification on why they bought the house in first place & I know deep in my heart that I did nothing wrong & I am still & always be happy as long as I am in my own house.

Afterall Guest worker program was one of the highly publized event of Pres Bush's 2004 presidential campaign. Which helped him win the race. In Florida and few other states(and few other blue states).
Congressmen(house and senate) know they are at a greater risk of losing in an election year by not producing a bill than producing one that dissatisfies few conservaties.
Basically talks about election year politics on this bill.

Same here. My labor was filed on July 07 and Audit reply was sent in August 07. Attorney has contacted DOL twice and got same standard reply. Mine was filed at Chicago though.
I have no idea why Chicago is taking this long for my labor. All of my friends who filed at Chicago after me got theirs certified. I am the only one stuck.
I think denying labor is better than keeping it stuck for almost 1 year in audit.

At this time there is no specific charter to address this issue, however, this is a problem that persists across the spectrum, and not only in employment-based immigration categories.
(I will bring this to the notice of the Core Group, however, one should take note that we cannot have a very broad agenda, as it would be challenging for us to approach Congress with requests).

I think that we need to point out to law makers that employment based petitioners are being differentiated from citizens . Whlie in their case the date of child is frozen on the date of the I-130 application, why not same treatment should be given for I-140.

I agree with the principles of giving aspiring students the ability to follow their dreams, complete college, and contribute to our society and economy. However, I firmly believe the separate passage of the DREAM Act would hinder our ability to ultimately pass comprehensive immigration reform and voted against it when it came before the House in December. We need comprehensive immigration reform now�for fairness, for families, and for our economy.
If we focus on only one aspect of immigration reform, we will not solve our problems. Such an approach unfairly excludes many important interests and groups from a solution. Employers need access to the legal immigrant workforce necessary to keep their businesses growing and should not be asked to act as law enforcement or punished for hiring folks with false identification if they made a good faith effort to authenticate it. Given the practicalities of the situation and our current budget constraints, we need to provide a path for legal status to those already in this country, not just for students or those serving in the military.
American jobs and businesses depend on a comprehensive immigration solution. Oregon�s own Coalition for a Working Oregon has done research showing how bogus impractical deportation schemes would lead to a loss of 76,000 jobs for legal workers in Oregon. This drop in economic activity would cost the State of Oregon as much as $656 million in revenue and lower small business income by 8.5 percent. It is time now for comprehensive immigration reform. It is the right thing to do for those who want to contribute to America, for our economy, and for our country. Half measures no matter how well intended undermine our ability to get to the real solution�comprehensive immigration reform.
Although the House of Representatives passed the DREAM Act on December 8, 2010, the Senate failed to invoke cloture, the procedural vote that is required to end debate and allow a final vote. As a result, the DREAM Act was not considered by the Senate prior to the end of the 111th Congress and legislative efforts must begin again in the 112th Congress. Please be assured I will keep your opinions in mind as the debate continues.

Also what is the number to call to Open a SR? Is it to soon to call since my PD is current only since yesterday. Folks who called to open a SR please let us know.

They will definitely answer that...for my case they did that twice, once from the West Coast IIO phone center (Immigration Information officer i.e level 2 after getting transferred from contractor level one) and the second time directly from a NSC officer.
They will not answer that. If you have filed via AR-11, you can assume it goes into their system instantly. I was in the same situation. I change my address in November, docs delivered in Dec came at the new address.
