Now; senators/congressmen who don't have much knowledge and you present to them why the country quota, etc., should be changed; will be given evidence through their research of what is going on with h-1b, labors in fast procesing states, etc., In this environment where there is sentiment against immigration it will fall on deaf ears and maybe even skew things in the future for you with the politicians because they are getting insight into this stuff at the wrong time.

I understand that you want to use experience before PD. However, there is no much gain and makes it more complex.

For example, the person who does not start PD for 5 years on work can get only 6 months earlier preference.

My thoughts.
For old PD, pending I-140 should not be bottleneck.

PD should be first criteria but US experience should not be ignored completely. US experience should be giving less point then PD.

10 points for each month for PD and 1 point for each month for being in US. GC priority should be created after calculating total points for PD and for being in US.

I think, this argument is wrong! Legally, any descrimination based on national origin is not valid.

Even if congress passes a law, it can be challenged in court - and court can declare the law as unconstitutional based on the basic rights allowed in the constitution. If we can prove that a law is against the constitution, court can declare it as invalid.

IN US, CONSTITUTION is above, CONGRESS, JUDICIARY and EXECUTIVE branch. ALL LAWS IN the US must obey the principles laid out in the CONSTITUTION.

At present, in the United states there are 1000s of (state and federal) law provisions which acts against the constitution. Until someone challenges those, it will stay the same.

Department of Justice's CIVIL rights division will take up cases related to any discrimination based on National Origin.

In this case, one arm of the Federal goverment is discriminating us and we need to have some help from the other arm of the government (Department of Justice) and the Judicial System, to prove this discrimination.

If we can prove in a court that this is discrimination , that day onwards, country quota will become invalid. Congress has to alter the law then.







I dont believe in flower/food/sos campaigns to resolve this problem...just because it worked once before doesnt mean it is going to work again..have we pursued a class action lawsuit against Department of State/Labor/USCIS for unlawful discrimination based on the country of birth in Employment Based Visas. Any idea if IV core ever took up this path? Can we attempt to do this? What are the costs involved and can we get some good lawyer representation to this goal?



You can only go in court if some agency is not following law disigned by congress. You cannot challenge congress in Court to change law.

Please contribute / Join State chapter / join evey campaign by IV . We have plan to fight for counrty cap along with recapture and some other stuff.

Well, my old carcass is getting too aged to handle that anymore. So now I ease off the sauce and go to the gym.
But I do also try to notice and enjoy the silliness of the every day human condition. (Still to this day, I'm not sure why I mow my lawn, for instance.) A sense of humour is very important. Recognition that there are others less fortunate. And stay connected with friends socially.
And also recognize that fact that a green card won't make me magically happier beyond the immediate jubilation. Yes it is good to regain the rights we lost coming to the US. To speeches I'll still smile, nod, even clap and think "what a bunch of nonsense!" for privacy is the true freedom that you still have. But I'll still work for a living. I'll still put on a dress shirt to impress clients I'll never see. I'll still try to spend more time creating than managing. Not simply because my h1b legally requires me to do so, but because managing is intellectually trivial. Or one could say that managing is the work of man, creation is the work of the gods. ; )

I hate to say this since I'm charged to the India queue as well. However this will not get solved soon. I saw on CNBC this afternoon that there were something like 53K H1b visas for Indians last year, next was china with like 8 or 9K, then others(I had no idea it was that lop-sided). When H1b visas are going so disproportionately to one country, the only solution to solve the EB green card logjam is to either put country caps on H1b visa or lift it on EB green cards. This is not opinion, it is quite simply a fact. Absent that, we can consider the EB green card route closed for anyone from India.
There is little and declining sympathy for the pro H1b forces. I suspect we will see highly restrictive legislation pretty soon, and based on the current sentiment wouldn't bet against it passing either.

There is no "approval notice" as such but a "Welcome Notice" which basically is a I-797 notice of action of the type: Welcome Notice. You will get this in one envelope per applicant.

You will get another envelope per applicant generally a few days later (1 week or so after the CPO e-mail) that has the GC in it attached to the exact same mailer that a EAD comes in; a pamphlet for new residents and a GC card cover (kind of cool!)

Actually i am in the same exact position as the OP and was wondering after approximately how many days, do we receive an approval notice sent email?

I got Notice welcoming new PR email on 8/5 and nothing after that.

At the risk of being repetitive - have you sent a email to IV (or sent a private message to "Starsun") with your transaction details of the recurring donations? If not, please do so. If you've already done so then please send a follow-up note. It typically takes a week from your original email. If nothing worked, please pick up the phone and call them up directly.

I still dont have access to Donor Forum, I have sent out email to IVCoordinator and Starsun with the transaction/Subscription ID.
