I applied for H1B and Change of Status in April 2007 and got approval for the same in August 2007.
I have to go to India so, I want to know Can I Travel outside US and re-enter on H4 visa (which is valid till 2009) before October 1st?(Before H1 becomes effective)
I am aware of the fact that you can not travel outside US while your application is pending. But in my case I have the approval. So is it possible?

You can come back to US on H4, but you may have to apply for change of status from h4 to h1 again, to be able to work in US.

the Alliant Energy CenterI have a question here. Since TSC processing time is 04/30/2007 and NSC is 06/08/2007. Does that mean even EB-1 will have to wait until the processing time to their RD ?
eg, If you are EB-1 just file your 485 this month, but the processign center time not get to 04/2008 for another 2 years, then even you are EB-1 which is always current(for right now), you still not able to get your GC in two years ?
more...Alliant Energy Center andIt depends on the service you choose, I think they have an option for expedited service and you can get the document within couple of days. They also provide you the pdf format of the document, you can print that document and submit immediately instead of waiting for the postal document.
I hope they dont support only a few languages in india. My wife has a birth certificate in kanada. Anyways thanks for the info and i will check more info on http://trustfortecorp.com/. It is a valuable information which will applicable to many people.

2. The tone towards DOL is accusatory and rather harsh. This would make them defensive and the letter seems to insinuate that they are doing this maliciously and are incompetent, both of which do not help our cause.
3. The letter should instead address the backlog and ask for DOL's cooperation in resolving the back log ASAP.
4. There is a typo in the letter "noT being processed" (paragraph # 2)

Possibly not. But it has to reach USCIS and I was thinking of getting through the liason process of the senators / congressmen.
If IV can take up this effort, then there is a channel that we can get through. But I dont think it is going to happen, because of the infights. Even if USCIS does'nt react, we can use this process to challenge the intrepretation and show them the mess that they have created. May be that will help
Sorry, i'm just trying to understand the situation here, please no flames.
If this is an admin area fix and USCIS is the main one whom we may need to convince, do we still need to contact/involve politicians in this.
Coming elections, and two different parties, this may give a different color to the whole problem, than solving the problem.

We are hearing from multiple sources that, on Monday or Tuesday of next week, State Department plans to issue a revised Visa Bulletin for July 2007.
This revised Bulletin would retrogress some or all of the employment-based
categories, very likely to the point of unavailable.
"multiple sources".....sounds classic rumor to me.
Reports from AILA
members about unusual levels and types of activities by USCIS indicate a
particular push to adjudicate employment-based adjustments currently in the
pipeline so as to exhaust visa numbers for fiscal year 2007.
I've read this statement several times...how does this indicate that there will be retrogression??? Also one unusual acitivity of USCIS has been to suspend premium processing of I-140 for the month of July. That to me suggests that they are preparing for the deluge of I-485s.
This follows the actions of USCIS in June, when it began rejecting EB-3 "
Other Worker" adjustment applications even though the Visa Bulletin showed
an October 2001 cut-off date, on the basis that the "Other Worker" numbers
for the year had been exhausted.
Again...aren't the mechanics, numbers allotted to this other worker category different from EB-2,3?:rolleyes:

What does the status say? "Approved", "Decision", "cards production ordered".. I heard the statuses change from Initial review to Decision, Cards ordered then Approved.
Just curios and keeping my fingers crossed for our case.

I know the feeling of the people who got stuck in BEC.
My Current LC PD is Jun 04 - EB2, before that I had two LC's PD of Jun 2001 and Sep 02 of EB2, Since I switched my employer I was unable to use those LC's even though I was promised by both Ex - Employers ( But it turns out to $$$$$ Demand from the Ex).
Since I made the decisions to switch employers, I don't have any regrets. And am I hoping for 3rd time luck now.
Rather than complaining about the systems, I think we have to focus on how
1) To get back the Unused Visa # from year 2000 (Almost 180K #'s)
2) To increase in yearly Visa # from 140 K to 280K or even more
3) To make USCIS to not to count the dependents towards the VISA #'s
The current USCIS policy counts all the dependents towards the available VISA #'s (I believe the formula is 2.5 per primary Applicant)
That means the country quota of 7 % (9800/2.5 = 3920) available to any one country (All the categories). If this is true, I really don't know when we can the see the light.
Of course IV is focused on this issues, I am basically reiterating it again. This effort needs humongous resources.
So please contribute $$$, your efforts and time.
Positive thinking will help to achieve the Goal
