The idea of a H1 transfer is a misnomer. Every application is a new H1. However, if you already are in a valid H1 nonimmigrant category then your new application is not subjected to the cap.

Whats the difference between H1 transfer and a new H1?

Thanks for the reply. I've also got canadian immigration as a backup and my visa is valid till April 20. I was planning to go to canada and come back to US on parole but my friends advised me to wait as from march bulletin it looks like my PD for Oct 05 will become current hopefully in the next bulletin. I was told that I might put the US case in risk as you never know what could happen when you come back.

What do you guys suggest?

Sorry I am not going to be help, but I would be interested in knowing when you find, why that was so.. I am one of the unlucky few whu missed the July 2007 filing bonanza by 1 day, based on when my labor was filed.. so if there is an alternate way to assign PD.. I can still continue crying....:confused:

Few months ago, my company filed for my 7th year extension and USCIS approved the extension for only 8 months instead of 1 year (my I-140 hadn't been approved yet). My lawyers contacted USCIS for clarification and we finally heard back from them. They say that the approval of 8 months is correct and gave no explanation for why it was not for 1 year (which I would have qualified for since my LC was approved when the extension was filed).

Has anyone else experienced a similar thing?

Yes. I did contacted both Kerry and Brown's office last month (July end) for my EAD renewal application.

Both office staff were very receptive. Brown office has more than one person working on immigration matter....and I believe they were first to act on my case. I got EAD approval 4 days later.

There Should be some link like this where general public can spill its views out.
This forum provides such platform. Hope giving comments and arguing would not go unanswered.

My I797 and I94 expired on Sept 30 2009. I have applied for an H1B extension on Sept 26 2009 using premiuim processing.
H1B extension got denied on Oct 29, 2009 after we responded to an RFE on Oct 19.
RFE required me to provide Tax returns, company wage report and employment agreement.
Can any one suggest what are my available options.
How long I can stay in US?
My lawyer is still waiting for the denial letter for more details.

Mine rejected case has status "OTHER REASONS" and receipt number is voidand it starts with "MSC". I did not receive package back yet.

My pending I-140 (filed an year ago...June 2006) was transferred from TSC to NSC on 09/05/2007, because my I-485 was filed with NSC. What date willl NSC use as received date to process my case...the date they received from TSC or the original receipt date?

Isn't it(140 filed at TSC almost an year ago) supposed to be certified by now?
TSC has been much faster at certifying 140s . Looks like USCIS is transferrring the 140s from TSC ... I can only pray for alll concurrent fileres that filed at TSC ...

140s at NSC are almost taking an year according to latest processing times.

It is unlikely that this would qualify for J-1 status, unless the caterer was coming here as a trainee of some sort. J-1 is for exchange visitors.

All J-1 visitors must have a �program sponsor.� There are �umbrella sponsor� organizations, e.g. the American Council on International Personnel (American Council on International Personnel (http://www.acip.com)) and the Association for International Practical Training (Welcome to AIPT.org (http://www.aipt.org/)). yes! thats what ac21 is for...

in my case, i talked to a lawyer before i did ac21. i will also talk to lawyer again if i change jobs again.

I left my GC Sponsered company in Oct 2008 and started working on EAD.. >> Filled AC21 in N0v 2008 thru a consulting company >>

Got RFE on employment verification on May 2009.. replied and have no comments from USCIS yet.. (assuming everything is okay as their repsonse time 60 days elapsed)

Now got rolled out from project and no paycheck form since june 2009

and Now found a project but the vendor wont do corp-to-corp..but only W2...

THIS CASE CAN I JOIN WITH this Vendor ON W2 With out applying for one more AC21??

Thanks for sharing, It describes about Numerical limit not apply during Quarter which means spillover should occur quarterly. I don't think they follow that today.
