There is a question on part 7 of AP efiling. I guess, same question is also there in paper form as well. Could somebody please explain as to what to do about this. Here is the question:-

It seems that i can file tax using form 4852....but to do if he send legal notice claiming that i have made losses to him worth 25 K....i had good relation with client , gave app notice and also have refe letter from client (received award form client)..........so there shud be no point for liquidation thing and also i have all previous employers emails acepting my receignation and notice period...

It seems to me something flagged in background check and they need to verify that

Guys, wakeup! He isn't telling anything wrong - just a different opinion, very valid for a great percentage of Indians - not everyone can/is going to land in US and wait eternally for GC? and nothing wrong in what he is saying - to go for a better long term India than a spurt of growth. Why ridicule the other guy for giving a genuine advice to youngsters - how many of us haven't almost given up on our careers just for the same of EB GC? Are we just afraid of losing out to our brothers in India in future, rather than them joining our batch in the eternal wait? If we want to make US our home, at least we should start respecting another person's right to his opinion, even if we disagree. Why would it be called a gimmick?! There is no other way - if its not India, it will be China, Philippines etc. Look at the way the general product industry went? The same will happen unless there are restrictive trade policy - which, not only would be against the "US" principals of free trade, but would also automatically be harmful for the US economy.

I personally don't see anything wrong in the article. He puts forth the right things that can be done to improve the life of Indian generations - now and for future. And if that happens, there would be a benefit for us in particular, and US economy and US jobs in general.

It has to be anyone of a rank signing the letter saying that you work in this position for this salary, someone like your boss, human resources, whoever is nice enough to sign it, they are not really strict on this one, they are on the I-140. Do you have that approved?

o Was glad but no celebration.
- How did the long wait upset your life?
o Yes for a while. But the entire episode changed my outlook and showed me a different perspective. After being frustrated for a while I realized I should not called myself �skilled� if I cannot navigate the rather simple green card mess. People are successful despite extraordinary physical handicaps and here I was restraining myself under the simple excuse of GC. I realized that I had to and could create oppurtunities for myself, without GC and without being in the US. Fortunately at that very time I got my EAD (June 2007). I gave myself a hard limit of 1 year and if GC did not materialize in a year I would ditch the effort and move to plan B. By april this year I began taking steps towards a change of job. My prospective job title was going were different but I was willing to risk the GC. Now I was wishing I should not get a GC since I would need to shelve plan B for 6 months. And suddenly on May 1st I got the GC, just when I did not want it!

o Tremendously. When GC was important to me, it gave me a platform where I could act to make a change. I haven�t been active but just contributed a couple of hundred dollars to the cause.

o No, the cause has long ceased to be important to me.

o Don�t create impediments for yourself by hanging onto GC and getting frustrated. Move on, there is plenty of good life outside clutches of GC!

Yes, don't worry guys. Once I-140 is approved, most of employment and job related stuff is over.

I-485 is mainly for status change stage to check criminal background (not job related :) ), FP and name check. They won't check much on job.

It is all straight forward and only a time consuming stage. Thats all. Enjoy the AOS pending stage.



This is confusing..I have a similar situation(not paid for 2 weeks)..

When i talked to my lawyer she said that employement verification is done in I-140 and since that is approved I dont need to worry abt it for 485??

What does your lawyer say?

Guys.. i'm sick of this nonsense.. I mean this is ridiculous.. this is my second go around in this stupid lottery.. last year I hadn't graduated so they put me in the bachelors quota.. this year the freaking masters quota is full.. i have a genuine offer from one of the big 4 accounting firms.. and have work experience to back it up

i'm sick of these consultant firms.. i wish I could work for the uscis and weed out these miserable cheapsters.. 6 years toiling in their education system, paying the damn taxes, and waiting for 1 smart person to come along and tell them its time to take care of these consultant companies and their consultants who get the jobs based on deceit and conmanship..

EAD/AP by CSC.

any idea on what are the processing dates for EAD and AP at CSC
and also finger printing timelines

Reading the forum I understand that EAD/AP approvals are coming fast from CSC.
I have not seen anyone posting about receiving finger Print notice if the case has been tansferred back to NSC from CSC.
This is the trend I have seen so far.
Anyone who has received FP notice if ur case has transferred from NSC to CSC and back to NSC - Please post.

No, that is not true. It has nothing to do with lawyers or the HR people. I-485 is YOUR filing (not of your employer's HR). By sending this you merely want to draw attention about something which you believe or hope should happen, and unless immediate attention is drawn you might suffer a loss (in this case, visas may be used up by others simply because someone did not care about your case, or just took the case to process and then went on long holiday etc. Such thing can happen and do happen particularly when paper files have to be worked with). Your explanation could very well be correct. These are all theories by people who try to explain the movement of these dates.

Regarding who decides what flows where is department of state. Congress makes laws and then the cabinet agency makes rules on how those laws will be implemented. While making these rules, the agency gets some discrition in situations such as this where law will allow more than one possibility.

After this it will have another round of hearing on June 23rd . Which is Full Commitee. Which will makr up bill and if passes there it will send to clerk for scheduling to debate on house floor.

Before it reaches to house we need to make sure we call CHC members and other lawmakers to educate them before bill on floor.
