For EB1 category people it is the Date on which I-140 was filed.:)

Hi I am a Physical therapist on H4.

company A wants to sponsor my h1. I have physical therapist license from STATE A and Letter from State B that they do not issue license without ssn no ( and i have letter from credentialing body also saying i meet all requirements for licensure for STATE B,I also have visa screen and other required documents.

can company A file An H1 with multiple LCAS - 2 states, so H1 is issued for 3 years

What service centre would the application go to-the one for which i have license of the one for which i have letter from board (ssn needed for license).

Once the h1 is approved can i work in any of the 2 states.

How long is the H1b taking to get approved if filed in regular processing and say no rfe is recieved

No. But the employer can file for 1 Year extension if there was a Labour or PERM was filed and it's pending. If I140 is approved and waiting for I485, employer can file for 3 year extension.

My online 485 status shows "card/document production" for a long time now and I did not get the card yet. I had contacted USCIS several times thru lawyer and never got any reply. My lawyer said that could have been a mistake.

I finally called hte USCIS directly and got the reply from the Phone rep that my 485 is approved and will open a ticket to find out why my card has not arrived. After a week or so I got a letter from USCIS quoting my earlier call and said my PD is Jan'04 and currently the availablity is only for Apr '02 and I have to wait till the PD is current for case.

There was never an explanation about why my online status shows the card/document in production.

In this case, what are my options ? Please help.

Can't explain the kind of emotional and psychological trauma we go thru ever since we saw online status and subsequent messages from USCIS.

I am currently on EAD from 485 application (no H1b)..My 485 is applied in eb3 category. Also i-140 is approved.. I have moved to a new position in the same compnay where the job duties are 50% different from the earlier position.The Position also entitles me to start another Green card application under EB2. My QUestion is


Is it possible to apply for another GC in Eb2 and use the EAd status from the Eb3 application? Since I do not have
an h1b my only valid status in US is EAD and 485 from the Eb3 application

I tried the suggestion solution: convert all the extensions to xps, then use DocumentViewer to display the file. It's quite neat. Short and simple code!

However, the adding comment part still remains to be solved...

I read somewhere that the new memo is effective immediately. So you should consult with your immigration attorney soon. You might be able to take advantage of the new memo and get 6 years of H1b.

You can retain your PD if your employer does not repeal your existing Labor Certification. In other words as long as your Labor is not cancelled you can apply in EB2 and get the labor approved (typically takes 3-5 months in PERM depending on how fast your Attorney is).

In fact, I am in the same boat, just waiting for my EB3 Labor to be approved.. I am a Manager + I also have Master's .. so, I'll also be doing the same.. Pls do share your experiences how the transfer is working..

I am from ROW and PD is 04/2002 which is current right now. Did the PP for I-140 and all medicals are done.

I am kind of scared of Name Check process. Lets see what happens.

Are you saying client company will not pay for the expenses or it will not sponsor H1 visa? If the Client Company does not sponsor H1 visa, i do not think you an sponsor yourself.You can pay for your expenses if client company sponsors H1 visa.

Last December, 2006 I got laid off because of company downsizing. My last pay stub was dated 12/15/2006. My LC was pending more than 365 days in my last company. Recently I got new job offer. My new company attorney is collecting all my immigration related information for filing H1-B extension from me. I have almost 60 days employment gap when my new company attorney file my 8th year H1-B extension.

I like to know the consequence of my 60 days employment gap. Whether my H1-B extension will be denied by USCIS? I will greatly appreciate your valuable suggestions as I am very much worried.

I met with a potential client who is an illegal immigrant living in the US. She has a child who is a US citizen. The father was voluntarily deported and the mother gave him permission to take the child back to their home country to visit the grandparents. The father was supposed to make sure the child returned to the US within 3 months. It has been 6 months. If my client files an application under the Hague Convention on the Civil Aspects of International Child Abduction, will the US Government begin deportation proceedings?

How long does it take to get the initial EAD...Continue working without pay (or is there a workaround) while waiting for EAD?....any problems getting visa stamped with a 'yes' for past immigrant petition filed...

I know this is irrelevant in a way but see it from a different angle for one moment. There is no other forum where you can get any information about these H1 employers who are playing games using retrogression. This is the only forum where most of the people on H1 are related to some desi consulting company and can share their experiences which would help other people who are in huge pain due to the unfair practices of their existing employers.

I would recommend the administrators to create a separate area on this forum where people can share these experiences and find genuine employers.

Not in this forum I would argue. There are other places.
