If you have not used EAD then your H1B is still valid and so spouse's H4 should be valid too. If you have used EAD then your H1B is not valid and in that case, your stay becomes illegal too.

If spouse uses EAD for employment, what I heard is that the H4 status is no more valid.

In this case for any reason, if the 485 is cancelled, spouse will be out of status.

Primary can transfer h1b (if possible) & still be legal, but spouse is illegal to stay any more. There is no legal provision that once on EAD, spouse can switch back to H4. Is this true? I am worried and don't know whats really true.

One thing that is certain is, the uncertainty of the USCIS :) So, no definite answer to if/when you will get RFE.

H1-B is all sponser based. You just can't go to USCIS and say that give my wife H1-B. You need an employer who is willing to hire her, show how much he is willing to pay and many more things. You say for a license she needs SSN, so there is your answer

I just want to know if a sponsor can apply for H1 Dentist for a canditate who does not have a dental license yet.
Its hard to believe that a H4 cannot convert to H1 on a dentist job for the lack of SSN - I am sure there must be many people who passed/going through such situation (H4 to H1 dentist) - just looking for someone to share their experience.

Filed 485 in vermont service center

I sent my application to vermont based on the USCIS answering system on June 30th that folks with approved I-140s should send 485 applications to the center where it was approved. Any ideas, if there is a problem with that and if the app gets transferred how much time it will take.

However, through August 17, 2007 only, employment-based adjustment applications filed at the California and Vermont Service Centers will not be rejected and will be relocated to the appropriate Service Center. my brother got recently married and his wife went to stamping in kolkata and they gave 221g for h4 and 2 days later they even cancelled my brothers exiting stamped H1 and his visa.he is in IT industry

any ideas whats next for him.
does he need to apply for a new H1B or can any lawyer help him convince.

We are in AOS pending status.iam on EAD.

After seeing the economy Iam planning to send my wife to india. She is pregnant ( 2 months).
Now I have job and in future if I get into any trouble with project Etc.. I need to pay the medical insurance and will have lot of financial issues.

How difficult is to bring new infant to US from India while our AOS is pending and apply 485.
( Visito visa Etc..)

Any suggestions.

You are NOT on a non-immigrant visa now and you are in AOS, Hence, if you kid is born outside the US, you would not be able to bring him/her on a non-immigrant dependent visa (H4). The only option, as a layman, I see is that file 485 for your kid in the consulate once your PD becomes current or file follow-to-join once gc is approved. Others can throw light on this!

How about adding "No control as Lawyer will not inform when he will file".
This option may be valid for many users using the Corporate attorney.

I filed my I-485 in July, Still waiting for receipts, Now my company got acquired by another company. My questions are-

Any actions required from my side? What will happen to my I-485 which is already filed, Do I need to re-file with new company?
If I get EAD in next few weeks can I use that EAD after 6 months of filing I485?

If any established school can prove to USCIS that they have a open position for which the candidate is a great fit and that they are unable to find a qualified teacher in the US (Citizen or Resident) for the same position. Then they can apply for a H1B.

i was on h4 visa and recently as i turned 21 i am no more dependent on my dad who is on h1 visa . i tranfered my status to f1 .But my dad applied his 1-485 recently along with my application for i-485 and he consult the lawyer too and lawyer told as i am not the main visa holder like if i was on h1 and i transferred to f1 and then apply for i-485 then my application can get rejected ; but not now as i was not the main applicant but was dependent of my father.

i dont trust everything wat lawyers say.so can anybody help me out with this issue.

It would appear that you are not giving us the entire situation. I am guessing due to the child status protection act your age is OK for dependent status due to I140 processing time take off your age at time of filing I485.
If that is the case did you transfer to F1 while waiting for your fathers priority date to become current?

If this is correct then your application should not be rejected but if you are to travel outside of the US you MUST have advance parole since being in adjustment of status makes your student visa null and void and therefore you are unable to re enter the US on the F1.

This is just what I get from what you are telling us. If this is not the case please provide full details so people can help you. However, remember we are not necessarily lawyers and our knowledge has been acquired, not learned at law school.

It looks like the picture is quite severely overexposed. Since you have a bright moon on a black background, depending on the relative sizes of the moon and background, the exact focusing point and how the metering works you'll easily end up with an overexposed moon (due to the dark background).
As an alternative , spotmeter the moon to figure out the exposure and/or use the histogram.

(a) I am currently in L1 and have a priority date of May 2004 and I am in EB3 category

(b) I have an approved I-140

(c) My 485 has not been filed yet

(d) I just got my H1 approved and it would be effective from Oct 1 2008

So, if I change my current job from Employer A to Employer B and if Employer B agrees to take over my Green Card Process,

1) Should I re-file my I-140? (I presume the answer is Yes, but don't want to be a smart a**, wanted to get it clarified to the maximum extent possible)

2) Will my current Priority Date be carried over? That is, can I re-file my I-140 with my new Employer B with the same priority date of May 2004?

3) If I can move from Employer A to Employer B and file my new I-140, should this be done asap and before Employer A revokes my current approved I-140?

4) How much time does it take when I file I-140 with premium processing? (I can probably find this from USCIS website, but wanted to know real-time experiences)

5) Within how many days of joining my new Employer B should I file my new I-140?

6) I understand that the Employer A can revoke my I-140 and use my approved labor for any other viable applicant, but I also know that the Labor Substitution concept ceased to exist from July 2007. What is the benefit for my Employer A to revoke the I-140?

7) Last, but not the least - Should I file for a new labor where I will get a new Priority date and go back to that (god forsaken) square 1?

In worst case, if 202-a5 was eliminated, do you thing EB visas will be diverted to FB? Will A3 give any protection to EB catagory? 202-a3 will give more protection for FB class due to 10 to 12 years of backlogs in 4th preference FB catagory? If so, it tottaly violates the quota in EB and FB class and there is no meaning of preference level.
