It's like a scam. I wonder how could labor substitution live for so long. My labor was filed in sep'2003 and I'm still waiting. My next door was planning to go back to his country and had never applied for Green card, but 6 months ago, when he had 2-3 months left for his 6th year, he got a labor and he filed I-140 & I-485 together. Now he and his wife works on EAD & I'm still waiting for my labor. What kind of @#@$@# is this ? And who know before my attorney receives my labor cert. it'll allready be 45 days and I will have to pack my bags. that'll be @#$@#$!!!!

Edited Note: I am really frustrated to see how you people interpreted this post. I am not from AP or any of those poor souls. In fact they do not even know who is YSR. They all died due natural cause and age. They are all more than eighty years old. I was trying to emphasis, in this forum we do not need to discuss about YSR. He might be a beloved leader for someone and corrupt for others. Whatever may be the case take your discussion to the relevant place. The reason I started this thread to emphasis that there are lot of people dying across the country and around the world and we do not need to hold prayer for every one or they poor souls are not different from YSR and they also deserve to be remembered in our prayers. But you highly educated folks did not understand that and gave more reds or am I not presenting it properly...?

Your assumptions are exactly right. Do you plan to invoke AC21 in near future? I think if you switch to a company who is willing to transfer your H1B, you can transfer it as well. This is what my attorney told me some time back when I was in your stage and can still avoid using EAD.

The purpose of maintaining the backup is for safety. Even if your 485 denied, you can still have some time period left on your H1 and can look for other alternative avenues to be here legally and can restart your GC process as well. Without this H1 backup, you have a very little time to do so.

(Though I got GC now, my H1 is valid till end of 2010 :) )

If the client is ready to offer employment to you, client will take care of everthing. Why you worry about the law suite? My best guess is he is just threatening you because he will loose money on you. If you want you can scare him saying that you will put a case against him in USCIS by various reasons.

My wife's current H4 is valid till Nov. She got her H1 also approved from Oct'2007. She checked the status this morning only on USCIS.

I'm applying for I-485 and adding her as spouse. Should I file for her advance parole and put her status as H4 in it?

What happens to to her H1 approval, if advanced parole gets approved also. Will she loose her H1 status?

You should put the status on the day you are filing, so if you are filing before she gets on H-1, her status would be H-4.
Question: Why do need to have an AP filed? Is it just to avoid the hassle of stamping?
Just getting an AP approved has nothing to do with the H-1 status. But if you use the AP to enter into US, there is a grey area if the H-1 is still valid or not. If you have an option try to keep her on H-1 and not use the AP, this will make sure that he has a valid work status even if the 485 gets rejected.

So this is pretty odd -- both are based on the same base dataset, and it looks like the second document calculates the % differently. Also not sure why one says "science and engineering" and the other says "natural science and engineering"

What zephyrr is saying is that you should be able to show that your promotion is a new job in itself and it is significantly different from the job you were doing prior to your filing for Green Card, although it might be in the same company.

You may be lucky You can have a GC without I-140 approval. True. Your GC status is subject to I-140 Approval


You may be unlucky, USCIS might have returned your application or there is some RFE etc.

I have given up hopes of getting an H-1B through the Master's quota. I applied on April 4. So there are no hopes anyway.

Now how can one get an H-1B through a non-profit organization. My understanding of this process is not very clear. I was under the impression (wrong impression!!) that if I can get a job at a Non-Profit place through a consulting company(I am an employee of the consulting company and not the Non-Profit org) and because my workplace is at a non-profit organization, I can get an H-1B that qualifies as one that belongs to the Non-Profit H-1B category.

Please clarify. I am trying to understand this clearly.
