06/10/2008: I-140 Premium Processing Reportedly Reinstated 07/16/2008 for Certain Limited Situation That Need 104(c) H-1B Extension

AILA has reported that USCIS will resume I-140 PPS in limited circumstances. According to the report PPS should be available for those beneficiaries whose H will expire within 60 days of filing the request, and who need the I-140 approval to become eligible for that additional H time. Please stay tuned for the official notice of the USCIS.

I applied on Aug 18 and got approval email on Sep 2....awaiting AP in mail

I applied for my AP on Aug 24th. I haven't seen any update on the case. May I know when you guys applied for it?

Thanks to the core group for working on this. If I may make another suggestion- have you thought about using Google checkout? For one there is no transaction fee till the end of 2007. This would be particularly beneficial if you're trying to collect smaller amounts like $20 every month. Second Google also gives a discount of $10 or $20 for the first payment depending on the amount. So it might turn out to be a lot better for IV when compared to PayPal.

can we just buy a vacation for the burger king (a.ka. steve king) and ask him to go to bahamas or cancun or somewhere.... so that we can pass the recapture bill....

How come a bill which talks about " ....authorize appropriations for fiscal year 2008 for military activities of the Department of Defense......" can link an amendment which talks about different thing i.e. "..Recapture of Unused Employment-Based Immigrant Visas..."

Senator CORNYN submitted an amendment intended to be proposed by him to the bill H.R. 1585, to authorize appropriations for fiscal year 2008 for military activities of the Department of Defense, for military construction, and for defense activiites of the Department of Energy, to prescribe military personnel strengths for such fiscal year, and for other purposes; which was ordered to lie on the table

Highlights:
a) Recapture of Unused Employment-Based Immigrant Visas

b)Worldwide Level of Employment-Based Immigrants.--The worldwide level of employment-based immigrants under this subsection for a fiscal year is equal to the sum of--

``(1) 290,000; and

c) Retaining Immigrants Who Have Been Educated in the United States

My friend 485 has been filed on 12th - to nebraska service center, but he mistakenly sent his ead & ap on 15th to Texus Service Center in Dullas.(Did not receive the receipt notice for 485)

Please let me know his options!

1) Do they reject his applications in TSC?.
2) If he file another set in Nebraska Service Center is ok?

My RIR is rejected. My LC is still pending.
My lawyer says it is moved to TR queue

If My case is moved to TR queue, does it mean very significant delay in getting my LC? Because in such a case this is my breaking point.Ready to quit and give up after these years and years if pain

It happened to me 3 years ago. They moved a bunch of LCs (from my company and also other companies in that region) from RIR to TR stating "unstable market" reasons. If your company has a freeze on hiring or a lot of lay-offs then it might happen. As USCIS claim to process all LCs by Sep 2007, you might want to wait till that and then decide on a future course of action. Or if you don't have a lot of wiggle room in your H1 then you can try the PERM route and atleast get your I-140 cleared.

As for me, I did just that and am in a much better position in my new company (in both, what I do and how much I earn). I am not suggesting you do the same thing but am just letting you know that there is always a way around this misery. Just dont get dejected; do a lot of thinking; talk to your friends/well wishers/family and then decide.

After going through all this , now we are hearing discussions that it is safe to maintain a H1B, (just) in case the 485 gets denied.

I for one would take my chances and switch from H1B to EAD.

From your post it seems your H1b transfer was denied and not H1b extension, i think you should correct the title.

If you go to company A then you will have to file H1b transfer again with company A. I think you can file an appeal in the meain time continue working for company B for 240 days (I am not sure of this but confirm with IV gurus or attorney).

I dont think this is true. Untill the company A revoked the H1 which is valid till Sep 2009, I dont think one needs to file for transfer again. Otherwise please provide the source for the same.

When you are filing for new H1B with new employer, it will not cancel the current H1B. There is nothing called H1B transfer. Everything is New only. The only issue is you need to prove your status and you will not be counted against the cap.

I think there are still some visas left for EB2 I/C but they want to distribute them judiciously.
Due to the random processing, seveal people had earlier complained to USCIS and Ombudsman. This may have probably resulted in drawing a line that would mandate following a RD by IOs.
On the other hand DOS has still not made any official statement as the visa may be available or would be available towards the end of month.
Thus all those people whose RD is earlier than the published RD and PD is within the window should remain hopeful.

My theory is that USCIS could not handle the load of all the calls from us to CSRs, the infopass appointments, the SRs being opened...It was pretty silly of them to have moved the dates to August 10 (NSC) when there were thousands of applications with the RD of July 2. Obviously, that resulted in tonnes of SR/Infopass requests. Makes me think there is no one unit within USCIS that can do _some_ analysis regarding the consequences of their actions. This organization exhibits no accountability to anyone, i guess only action from Congress can make it be a little more responsible, but that doesnt seem a possibility as Congress doesnt really seem to have any incentive taking that route. (Even if all 300 of active IV folks cry out loud!)

I am going for an InfoPass appointment tomorrow and thought of asking the members is the following questions seem appropriate. I dont expect the officer to answer all/any of them..but just thought of listing them..incase I get lucky and get a helpful officer.

- Is my case with an IO desk?
- Since when is it with an IO desk?
- if and when my background check updated?
- is background check same as IBIS check? If not then is IBIS check complete?
- if and when my FBI name check completed?
- is review awaiting some response from external agency
(Consulate post/FBI/BCP)?
- If under "additional review" What kind of "additional review" is it under?
- Expected time-frame for the additional review to be complete?
- Is it being actively worked on or just assigned to an officer and not updates?
- Is it being transferred to other/local office? Is any interview being planned?

"Word-of-Mouth" seems to be the most effective way of campaigning! I had sent mails, and left voice to couple of my friends some time back. They became aware of IV, but not yet registered. Talked to them today, and got both of them registered. (kasas & aksrao).

Requested them to spread the word, "IV". I am sure they will read this thread and campaign for "IV".

Okay, I got so much helpful advice on the last one, try this shot!

I was heading into yosemite just before sunrise and caught the pre-dawn light over Half Dome. But your eye is able to discern a different dynamic range depending on where you focus, so the picture looks different than I saw the scene. For example, the sky is bright and fiery, but I have lost almost all contrast on the mountain itself. Is that a problem from a photgraphic viewpoint? I'm pretty sure it must be, but maybe it's pleasing enough as is, or you all can advise me on some post-processing to spiff it up. All help appreciated :)

i am not sure if my lawyer has the receipts. my case was sent on 6.29.2007 and received on july 2nd.
i got my FP notice (for my wife also) yesterday in mail for 9/25 appt.
from the receipt number on FP notice i checked it on USCIS website. it says that they received the 485 app on 30 aug. and the LUD on 485 is 9/3.

Did your 485 get transferred to another center?

I am asking because my 485 was filed in NSC, went to CSC (along with my EAD and AP) and I got a transfer notice from CSC that my 485 has gone to NSC and the RD is 28th (I am a July 2nd NSC filer). Trying to gauge if my 485 receipt notice will have Aug 30th or July 2nd date.
