It seems like every one is yelling and trying to make others feel low if they didn't attend rally or didn't contribute...

The website is free and its up to individuals to do what ever they want ...
May be they will feel the heat or retrogression after 2 years or so and start doing something about it (like contributing..

All i am saying is do not chase visitors away with your anger...

That's what I am suggesting. Look back the first reply message. One doesn't gain authority and yell on others just because the person attended the rally.

when did you file your 485? I really woudnt balme you for calling multiple times..but if its been 60 days since the current processesing dates(check the processing date of the service center you filed your case at) then there is absolutely no harm calling them to check the status.

Finally, I am current now, I spoke to IO today again ( Again means I call them every month, every week atleast once & So far I got Nice IO's)
She said your case is in current processing time, has not been yet assigned to any officer. checked all the status NC/SC/FP, everything is clear, just waiting for an officer to be assigned. call back after 15-20 days If I dont get any response.

I wanted to know that what impact does one have for calling IO's multiple times.

i thought india EB quota had a hard constraint of 7% but 17000 seems to be much higher than that out of the total 140K, can somebody explain

Did you LC mention the requirements for your job. Unless it emphasized that a Masters was needed for your job profile on an LC, I140 will be denied. File an MTR right away along with a new I140 uner EB3. Beleive in god and ur priority dates will remain the same as they were. Make sure that the new I140 under EB3 matches your LC.

Non-compete is based on a state law. Consult a Virginia employment attorney. Generally non-compete doesn't have teeth, because every one has got a right to work and practice your profession/make living.

It seems no one else is in this boat. Strange.

My friend had a similar RFE and he got a month to answer. Luckily he found his I-20 copy.

Couple of things you can try.

1. Contact the previous company/HR/Lawyer that filed for the first OPT/H1b for you and they might have a copy of it. Most companies/lawfirms retain the files or archive it rather than destroying it. This is the best bet.

2. Whatever the lawyer suggested along with any proof of your I-94 with D/S stamp from your student days along with clear copies of passport stamps with DOE and exit.

And with a new USCIS leader, it might get his attention, when he/she is trying to learn about what all needs to be taken care of.

I received my EAD recently ,I-140 got approved (separate filing) last year and 485 still pending (not reached 180 days so far).

Now i have the following questions.

1) If anything happens like layoff with my current employment , is it possible to use AC21 wihin 180 days of 485 filing may be with the similar new job?

2) I have worked a for the past 5 years in this country, and how come bcz of my current company lays me out then my 485 will get affected?

3) if it is not possible to use ac21 , can i join another company to apply for a new LC , I140 ,I485 again, if so i have only 1.5 years left .. is that okay ?

4) I cannot get the LC copy also from my employer if at all i want ti use ac21?

I was watching FOX News this afternoon around 3:00 pm EST and they talked about a Polish Lady sueing the USCIS. Her lawyer was on the show and he talked about the issue. The host then talked to a Congress man (i think it was Tom Lombardo and he said that the US is bringing in a way too many immigrants and the US should stop it for a few years). When asked if the woman was wronged he rephrased the word wrong by "was caused inconvenience". Anyways, the lady's lawyer hit the nail on the head. When asked if she was sueing to get a green card. Her lawyer said no. He said his client was sueing for financial damages and also for allowing her to submit her application as submitting the application has benefits.
