I would like to know what you had filled in DS 160 application. Have you ever been refused visa or admission withdrawn application. Is it Yes or No. My spouse h4 (I 539)was denied as I 94 was expired hence leaving country for H 4 stamping.

send your all your transcripts to www.wes.org and ask them to evaluate your transcripts. They will confirm whether your education is equivalent to US Education or not.

My wife had a BA (3 years) and BEd (1 year) and after the evaluation, they considered it equivalent to a 4 year US degree with Bachelors degree.

Based on what you said, the lawyer is right, however you can use the EB2 stream using the BS+5 years requirement, rather than the MS requirement.

I am planning to visit India next week. I have the I-94 which was given to me when I entered USA last time. In the mean time, I also have I-94 attached on the approved I-797 due to 6,7 and 8th year extension. My question is

When I check in at the airlines counter do I have to only submit the I-94 that was given to me at the port entry ?

or

all the I-94 that is attached to my I-797 approval notices.

As I mentioned in my post, I have applied for H1 in India in April,2007and got approval in August,2007.

My Approved H1 B petition does not have change of status i.e 1-94.

I came to USA on L1 in Feb,2008 and working till date. and my I-94 is valid till Feb,2011.

As I want to shift to H1 B,I think I need to go out of country i.e Canada from USA for H1 B stamping.

My question is:

If for some reason, I have not issued H1 visa at Canada consulate,
Is my L1 is still valid and Can I comeback to USA on my L1 visa and I-94? and Can I continue working on my L1 in USA?

Please suggest me the better approach.

My objective is to switch to H1 using my old approved petiiton and not want to go back to India for H1 stamping.

I have still 7 months left over on my 6 year term and they have asked for 3 year extension based on the approved I-140.I'm talking to my company right now and will talk to the lawyer once they receive the denial reason which they should get in 2 -3 days.But my company is ready to appeal.Keeping all this in view if they file for an appeal for what ever reason and based on my visa expirt date which is on 31'Mar 2009 how long will I get to stay and work legally to hear the answer for the appeal??

If you don't trust your sponsor then I would recommend finding a new one. You will be in position for many years where you need a sponsor that you can trust.

You will certainly want to get a copy of the I140 when that is eventually filed. You may have a long wait before you can file for I485, and you will need the I140. Some employers held people's feet to the fire to get a copy of the I140.

I submitted my 485 on July 12 and I got an 08/05 LUD on my pending I-140. Could be coincidence or they checked my 140 as part of the initial 485 processing...

I called Cornyn's office just now - male staffer got really annoyed when I
asked him if Senator Coryn supports displacing well-educated American
workers with Foreign H-1B Visa holders. He immediately passed me off to a
voice mail box of a staffer who handles immigration matters. (Yes, I know
H-1B's are so-called "non-immigrant Visas" but we all know most of these
people end up staying here -)

Of course the staffer did not pick up his phone - but the staffer's name is
Landon Bell. Why not ring up Senator Corn-Hole's office and ask for Landon
Bell, and ring Landon's bell a bit?

I called Cornyn's office just now - stated my opposition of course. The
person I spoke with said that Cornyn was trying to get his bill introduced
today, and he was not sure if it would be voted on today.

Hopefully Cornyn fails. I think he is getting our message, but I also
think he does not care.

Maybe you all have different information that I just obtained from both
Senator Pete Domenici's office (Republican) and Senator Jeff Bingaman's
office (Democrat) -- both of New Mexico. But both of their offices claim
that Skil Bill "Access to High Skilled Foreign Workers" S 2691 has NOT left
committee yet and thus cannot be voted on yet. (It is certainly possible
that you all have different or better information than was conveyed to me
but this is what I obtained.)

Domenici's office staff person couldn't tell me which side of the fence he
was on as he hasn't "made a press release" yet. And, as long as it is in
committee he apparently doesn't voice an opinion.

Senator Bingaman's office staff also told me that he had not expressed an
opinion to him on his position on the bill. The young, female staff woman
who answered the DC phone seemed STUNNED when she pulled up the bill and
started to read parts of it. She thought they'd have to take some kind of
special test to get into the USA for these jobs -- no. I only wish she
were casting a vote as I know how she'd vote! Again, she told me that
the bill was not out of committee YET and the Senators are going home
tomorrow afternoon. They are doing "yesterday morning's" work tonight or
some such backward thinking. There has been no floor debate on the bill so
the staff claimed would mean there will NOT be a vote on the bill tonight.
No one would guarantee me that NO voting would take place tomorrow but did
say it was UNlikely.

Finally, when I got to the staff woman in DC she was a bit surprised
because someone had called her on the bill from one of the Senator's New
Mexico offices. (A bit strange unless it was my calling the Senator's 800
number which connected me some place in New Mexico and they called the DC
office for information regarding my inquiry.)

(BE careful when you call, however, one Bingaman's staff males that I
spoke with tried to give me the WRONG Senate Bill number reference. He
asked "This is Senate Bill 2626?" I said "The one I am calling on is
"Senate Bill 2691 "Access to High Skilled Foreign Workers" so unless the
bill has been reassigned a number that I don't know about -- I am calling
on the Skil Bill "Access to High Skilled Foreign Workers.")

Oh, yeah! the woman from Bingaman's office said "Oh, THAT's a
Republican sponsored bill!"

I, too, phoned Cornyn's office and the person I spoke with kept insisting
that the H-1B's had to be paid the same as Americans and then he said the
senator wants to make America more competitive by bringing in skilled
workers. I directed him to Norm's article in the San Francisco paper and to
the Programmers Guild. I asked him how it would make our nation more
competetive to bring in a worldwide supply of cheaper labor to take our
jobs. Silence.

Thanks for your detail explanation. I dont have any siblings in India, and i am an alone child. Regarding my savings, i have been a full time employee of the company for which i work since i was on my CPT and now as i am on my OPT. Now the question to me is that since i have about 16k dollars in my saving account right now, should i sponsor them based on my OPT or should i just remit all the amount back to india back into my fathers account, and ask him to self sponsor him.
I have heard that the visa officer does ask you about the transactions that are fairly big and failry recent ones. Woudnt it create a further doubt if i transfer this savings back to my fathers account, and be in more problem.
Please Guys , if you can share your advice here, it would be really helpful for me here. I really dont want my parents visa to get rejected the third time.

Myy EAD is expiring and Renewal is taking more than 1 year as per new processing times.

Can I switch back to H1-B. I am in EAD and I dont have any H1-B status now. I have used 5 1/2 years of h1B previously. Six years is not utilized

It is more than likely a computer glitch but it's always worth it to check with the USCIS. A few years ago the status on one my approved old H-1B cases changed from Approved to Initial Review. It shows the same (Initial Review) status till date. It did not affect my current and/or future H-1B approvals.

we transferred this case I140 IMMIGRANT PETITION FOR ALIEN WORKER to our LINCOLN, NE location for processing and sent you a notice explaining this action.
