One minor side effect is that India EB dates might further retrogress because still there a lot of folks with PD 2001,2002 etc pending namecheck clearance.

For a moment, leave the IIT/merit/experience arguments aside...fact is US graduate schools get taxpayer funds...and one way or other students graduating in US get benefit from those taxes. Senators do not want their tax $$ investments to leave the country...that only is the reason they did something for US graduates in H1...this separate quota may or may not fly...as there is no direct benefit for US...stay on H1B and pay taxes good for usa :cool:

Also shops/ people who have purchased substitute labor during the July 2007 window and faked lot of other things and are enjoying Ead's now.

When hundreds of genuine people stuck in EB3 from 2002, 2003 are unable to port or start new applications waiting forever. People with Substitute labor are able to show 3-4 years experience since 2007 and are porting leaving genuine EB2 and EB3 applicants behind.

Initially I too got the same doubt that it could be a prank from my friend. But the name of the person who called me matches with the name of the person who visited my employer's office around 2 months back. After I got a call from ICE officer, I notified the same to my employer and explained about the call.
Really donno what to do.... Even though the ICE officer took prior appointment for visiting me, should I still contact attorney?

The employer will not be able to get anything from you. Again, it does not matter whether you sign it or not, the clause has no legal power.

amitjoey, Thanks. I have sent a request to my senator yesterday and also mailed them all the copies of the documents. Just hoping that will also help. I was told that my file is already assigned to an IO and you will soon hear from USCIS. "Soon" in USCIS dictionary seems to be 30 to 45 days and thats very scary s that means it will about 130 days. I am just hoping they will approve soon. After approving it seems they are taking additonal 30 days to print the card.

we saw the status updated this morning atlast. Hopefully will get the card soon in hand.

My wife's EAD renewal was e-filed with a receipt date of june 6 th, almost 120 days, still waiting. Got biometric notice for july 1st and finished it.After 94 days called 1-800 to request expediting the case on sep. 11 th, they sent a RFE asking for I-94 copies and stating biometrics were not transmitted to them and needed information on that, along with enlarged copy of photo ID.
Responded to RFE with a receipt date of sep. 25 th and no updates till day.
Called on 9/3 asnd raised a 2nd SR for expediting. AS her EAD expired on oct.1st and was given 1 week to produce new EAD by oct 10 th by her employer.

As a precursor to abolishing labor substitution next year, USCIS is increasing its scrutiny of substituted labor. Also there is rampant fraud in labor substituions.

I was reading somewhere that USCIS rejection rate of labor sub is 85% higher than in orginal labor. That is a significant percentage, if you ask me. Make your own decision but be very wary of promises.

visit your senator's website. Look for links for "casework". Look for contact person for immigration. Call your senator's office at that number. Explain your problem. They will ask you to write a letter giving your case information and requesting them to find out the status. Some senator offices may require you to fill some form in a format pertinent to them with the intention of giving the senator's office permission to inquire on your behalf and to give access to your personal information.

Once they have letter from you they will contact USCIS on your behalf. They will tell you by when they will hear back from USCIS. Make sure you do not call them repeatedly, call them when they ask you to call them or call them after a reasonable amount of time i.e. 2 weeks.

It was for about 2 minutes. The first time this issue got TV coverage I guess.

CNN had a 30 second clip on it on "American Morning" on July 3rd.

There is a petition to capture lost visa. If lost visas are recaptured, there will be some relief.

At least that would definetely help. Apparently over the past 5 years they have lost 180,000 visas just becuase.

You can bring UP TO 4 spouses on H4 visa. That's why it is called H4. Similarly on F2, you can only bring 2 spouses, Ah...students do not make that kind of money to support more than 2 spouses. USCIS thinks so much about us.

I am just talking out of my A**.

One important observation is that EB2 India/China shouldn't celebrate until State changes their planning style. If CIS wastes visas due to swing movement by State, EB2 I/C doesn't move so much and numbers will be wasted. So it is important that IV push state to incorporate long term planning and add the CIS processing as a lead time to calculate visa dates movement at least for post July 2007.

With the current rate of outsourcing happening around in US and the rate of influx of temporary workers coming in on mostly L1 and may be few on H1 B Visas every year through the outsourcing companies , i am sceptical about the future of GC aspirants. With the way of GC processing happening which are caused by restrictions /policies of governing bodies and no sight of positive relief in near future i am little apprehensive about the future.

I feel that there might be no areas that are not impacted by Outsourcing boom . Most of the companies that i see and my friends work ,i see many of the operations are outsourced or planning in place to get outsourced.

with the current rate of outsourcing and subprime mess which may cause slow down in economy , i am not sure if there would be any positions to support our AOS , when our PD becomes current. Some times i think , the fight for GC is even worth it.

The impact of outsourcing (if any) would only be on lower level software/IT jobs which are getting sent to cheaper destinations. However the GC applicant pool is much wider than just IT/software programmers, so overall the impact would be smaller.
